A regular session of the Pawtucket Board of License Commissioners was held Wednesday, April 10, 2024, at 7:25 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

 

Present – President Mercer, Councilors Araujo, Coderre, Gregor, Moran, Moreno, Rubio and Wildenhain.

 

Absent – Councilor Stachowiak.

 

Chairperson Mercer presided.

 

The reading of the records of March 20, 2024 was dispensed with and the records were APPROVED as prepared by the Clerk,

 

Upon motion made by Councilor Araujo, seconded by Councilor Moreno, the *Consent Agenda was APPROVED, on a unanimous voice vote.

Speaking was Attorney Nicholas Lambros, 100 Midway Road, Cranston, RI, representing the applicant.

 

Also present was Hitesh Patel, 5145 Country Pine Drive, Myrtle Beach, South Carolina, applicant.

 

Mr. Patel stated that he has family here, and he is planning to move here. He had worked at a gas station in South Carolina.  Alcohol is sold at gas stations in South Carolina.

 

He will keep the outside of the store clean.

 

Mr. Lambros stated that all Patel owned liquor stores are separately owned. Mr. Hitesh Patel is 100% shareholder of this store

.

 

Also, speaking is Attorney Joseph Lamagna, 2417 Mendon Road, Woonsocket, RI, representing the current owner.

 

Mr. Lamagna agreed that all claims must be paid.

A FORMAL HEARING ON THE FOLLOWING LICENSE WAS TAKEN UP:

 

CLASS D –

 

Happy Hour Club, 404 Benefit St. LIC#4035 #3460

 

Representing the City of Pawtucket was Frank J. Milos, Jr., Esq., City Solicitor.

 

Also present was Karen Tremblay, 68 Slade Street, Pawtucket, RI, license holder.

 

Ms. Tremblay was sworn-in by City Clerk Richard J. Goldstein.

 

Mr. Milos stated that an agreement was reached with the license holder.  Under the agreement, if approved by the Board, count 1 in the summons would be dropped and the license holder agreed to pay a $250 fine for the violations under counts 2 and 3.

 

Ms. Tremblay stated that she is now clear regarding entertainment requirements and agreed with Mr. Milos’ description of the agreement.

 

The hearing was closed.

 

 

THE CHAIR RECOGNIZED COUNCILOR MORAN.

 

Upon motion by Councilor Moran, seconded by Councilors Coderre and Moreno, the board ACCEPTED THE PLEA OF NOLO CONTENDRE BY THE HAPPY HOUR CLUB, 404 BENEFIT STREET, LIC#4035, AND IMPOSED A FINE OF $250.00 TO BE PAID WITHIN 30 DAYS, WITH NO SUSPENSION, for the following reasons:

 

1.  On or about January 27, 2024; February 22, 2024; March 17, 2024: Operating after hours. (Violation of R.I. Gen. Laws § 3-7-7, Pawtucket Ordinance § 108-18 and Rule 1.4.18 of the RI Department of Business Administration – Liquor Control Administration entitled “Hours of Business – Retail”).

 

2. On or about February 16, 2024: Entertainment without a license.  (Violation of R.I. Gen. Laws § 5-22-4, Violation of Pawtucket Ordinance § 193-1 entitled “Licensing Required.”)

 

 

Upon motion made by Councilor Araujo, seconded by Councilor Moran, the meeting was adjourned at 8:11 p.m.
