A regular session of the Pawtucket Board of License Commissioners was held Wednesday, October 25, 2023, at 7:30 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 
Present – President Mercer, Councilors Araujo, Coderre, Gregor, Moran, Moreno, Rubio, Stachowiak and Wildenhain.
Absent – 0.
Chairperson Mercer presided.
The reading of the records of October 11, 2023 was dispensed with and the records were APPROVED as prepared by the Clerk, 
Upon motion made by Councilor Araujo, seconded by Councilor Wildenhain, the *Consent Agenda was APPROVED, on a unanimous voice vote.

ENTERTAINMENT –
A. Petition of Pawtucket Family YMCA, for a license to have Trunk or Treat, at 20 Summer Street – outdoors, on Saturday, October 26, 2023, from 5:00 p.m. to 8:30 p.m. LIC#16096 STREET CLOSING – MAPLE STREET.

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR A LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, WAS TAKEN UP:
Zero Hora Lounge (Zero Hora LLC) 245 Esten Avenue, Unit D, LIC#16088®
Speaking was Adelino Lopes, 27 Whitman Street, Pawtucket, RI, applicant and Ruana Cabral.
Mr. Lopes stated that he will rent the space for parties and events.
He will sell liquor and frozen food. Everyone is TIPS certified.
They will be open when they have events. Camylla’s will cater the food. They may also be open on Fridays and Saturdays.
Upon questioning from the board, Deputy Clerk Michelle Hardy stated that a caterer cannot bring food into a Class B Victualler establishment. The food must be prepared on the premises. The applicant can either apply for a Class B license or a caterer’s license.
The board recommended that this matter be postponed until the applicant decides for which license he wishes to apply.
There were no other speakers. The hearing was continued.
THE CHAIR RECOGNIZED COUNCILOR GREGOR.
Upon motion made by Councilor Gregor, seconded by Councilor Araujo, the following petition for license was POSTPONED and the hearing was CONTINUED until November 8, 2023, on a unanimous voice vote:

A FORMAL HEARING ON THE FOLLOWING LICENSE WAS TAKEN UP:

One Stop Super Liquor Store (New England Brew Corporation) 390 Smithfield Ave. LIC#13637
Representing the City of Pawtucket was Frank J. Milos, Jr., Esq., City Solicitor.
Mr. Milos stated that he spoke to the license holder’s attorney earlier today. He stated that an agreement was reached in which the license holder is admitting to the two violations and accepts a plea of Nolo Contendre. If accepted by the board, the plea would result in a fine of $500.00 to be paid within 30 days with no suspension, for a first offense.
Speaking is Bing Zheng, license, holder, who has been sworn in by the City Clerk Richard Goldstein.
Mr. Zheng noted that his attorney would not be present.
Mr. Zheng admits to the two violations.
He stated that he tells employees to check IDs.
There are no other witnesses. The Hearing is closed.
THE CHAIR RECOGNIZED COUNCILOR STACHOWIAK.
Upon motion made by Councilor Stachowiak, seconded by Councilor Araujo, the board ACCEPTED THE PLEA OF NOLO CONTENDRE, BY ONE STOP SUPER LIQUOR STORE (NEW ENGLAND BREW CORPORATION) 390 SMITHFIELD AVENUE, LIC#13637 AND IMPOSED A FINE OF $500.00 TO BE PAID WITHIN 30 DAYS, WITH NO SUSPENSION, for the following reasons, on a unanimous voice vote:
1. On or about August 31, 2023 and September 25, 2023: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).
Upon motion made by Councilor Araujo, seconded by Councilor Moreno, the meeting was adjourned at 7:52 p.m.
