Pawtucket Board of License Commissioners

A regular session of the Pawtucket Board of License Commissioners was held Wednesday, July 5, 2023, at 6:54 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 
Present – President Mercer, Councilors Araujo, Moran, Moreno, Stachowiak and Wildenhain.
Absent – Councilors Coderre, Gregor and Rubio.
Chairperson Mercer presided.
The reading of the records of June 21, 2023 was dispensed with and the records were APPROVED as prepared by the Clerk, 
Upon motion made by Councilor Araujo, seconded by Councilor Moreno, the *Consent Agenda was APPROVED, on a unanimous voice vote.

Speaking was Roberto Garcia, Jr., 60 Hilton Street, Pawtucket, RI, applicant.
Upon questioning regarding the removal of the trailer from the property, Mr. Garcia stated that he needs to repair the tow truck before he can remove the trailer. The parts were ordered for the tow truck and he is waiting for delivery.
There were no other speakers. The hearing was closed.

With majority consent of the Board, the following motion made by Councilor Araujo, seconded by Councilors Moran and Wildenhain, was PASSED on a unanimous voice vote:
The Clerk is instructed to issue a summons to Halo Lounge (JDT Entertainment LLC) 25 Broad St, to appear at a Formal Hearing on Wednesday, August 9, 2023, for the following reasons:
1. On or about June 26, 2023: Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state or ordinances of this city to be violated. (See attached police report.) (Violation of R.I. Gen. Laws § 3-5-23).
2. On or about June 26, 2023: Refusing official’s access to licensed premises (See attached police report). (Violation of R.I. Gen. Laws § 3-2-6) (“If any inspector or other officer charged with the duty of supervision or inspection of places licensed under the provisions of this title is refused access to any licensed premises at a time when any person is within the licensed premises, after exhibiting his or her credentials if requested, that refusal shall be a sufficient ground for the suspension or revocation of that license”).
