A regular session of the Pawtucket Board of License Commissioners was held Wednesday, August 9, 2023, at 6:56 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 
Present – President Mercer, Councilors Araujo, Coderre, Gregor, Moran, Moreno, Rubio, Stachowiak and Wildenhain.

Representing the City of Pawtucket was Frank Milos, Jr., Esq., City Solicitor.
Mr. Milos stated that a disposition on this matter was worked out pending approval by the board.
He stated that the city was not moving forward on count 2 because firefighters were not prevented from entering the establishment.
He stated that the state food service license has been reinstated, which was count 3.
On count 1, Mr. Milos recommended a $1,000 fine for failure to keep an orderly house. The fine will be stayed for 90 days.
Also, two police detail officers will be required on Friday and Saturday nights, from 10:00 p.m. to closing through December 31, 2023. However, the license holder may request a review of the detail requirement after October 31, 2023.
Speaking is Diana Proto, license holder, 5 Mountain Street, Providence, RI, who is sworn-in by City Clerk Richard J. Goldstein.
Ms. Proto agreed with everything that Mr. Milos said.
She is upset with the actions of the patrons.
She has a good relationship with the fire department.
She wants to work with the city to be a good business.
She stated that they should have moved patrons out of various doors, rather than having all exit through one door.
She understands the need for detail officers, but it is cost prohibitive.
Speaking via Zoom is Jeremiah Sullivan, 25 Broad Street, Pawtucket, RI, who is sworn-in by City Clerk Richard J. Goldstein.
Mr. Sullivan stated that the fire alarm went off, and the building got cleared. Fire fighters were allowed in the building.
People took pictures on the fire trucks, and because of this the establishment is being penalized, which is damaging their business,
Mr. Sullivan is upset with the city. He stated that no one in the mayor’s office or the board has helped them since the beginning.
He told Diana (Ms. Proto) to close the business and move elsewhere. The business is being punished for actions of the patrons.
He stated that Halo Lounge is not Vibe Lounge.
There are no other speakers. The formal hearing is closed.
THE CHAIR RECOGNIZES COUNCILOR CODERRE.
Upon motion made by Councilor Coderre, seconded by Councilor Araujo, the board ACCEPTS THE PLEA OF NO LO CONTENDRE AND IMPOSES ON THE LICENSE HOLDER, HALO LOUNGE (JDT ENTERTAINMENT LLC) 25 BROAD STREET, A FINE IN THE AMOUNT OF $1,000.00 TO BE STAYED FOR 90 DAYS. ALSO, TWO POLICE DETAILS WILL BE REQUIRED FOR FRIDAYS AND SATURDAYS, FROM 10:00 P.M. TO CLOSING THRUGH DECEMBER 31, 2023; HOWEVER, THEY COULD APPEAL THE REQUEST FOR POLICE DETAIL AFTER OCTOBER 31, 2023 for the following reasons, on a unanimous voice vote:
1. That Halo Lounge admits to the June 26, 2023 disorderly house allegation asserted by the Pawtucket Police Department and memorialized in the Summons issued by the Board on July 12, 2023. Specifically, Halo Lounge admits to its failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where they are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state or ordinances of this city to be violated.
2. That as a result of the aforementioned admission, Halo Lounge agrees that the Board shall impose a fine in the amount of $1,000.00; however, the imposition and payment of the aforementioned fine is stayed for a period of ninety (90) days. If the Board has reason to impose the fine during the stay period, then the fine shall become due and payable within seven (7) days of notification by the City Clerk’s office.
3. In addition, Halo Lounge agrees that a Stipulation shall be added to its Class B (Victualer) liquor license, requiring two detail officers on Friday and Saturday nights, from 10:00 p.m. to 2:00 a.m., commencing immediately through December 31, 2023. However, the license holder may petition the Board in writing for relief of the Stipulation after October 31, 2023.
