A regular session of the Pawtucket Board of License Commissioners is held Wednesday, September 7, 2022, at 7:12 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

 

Present – Councilors Araujo, DaRosa, Gregor, Mercer, Schuette, Stachowiak, Vasquez and Wildenhain.

 

Absent – President Moran.

 

Vice-Chairperson Mercer presides.

 

The reading of the records of August 24, 2022 is dispensed with and the records are APPROVED as prepared by the Clerk,

 

Upon motion made by Councilor Araujo, seconded by Councilor DaRosa, the *Consent Agenda is APPROVED, on a unanimous voice vote.

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., City Solicitor.

 

Mr. Milos states that the license holder is willing to accept a plea of Nolo Contendre, which, if accepted by the board, would result in a fine of $500 with no suspension, for a first offense.

 

Mr. Milos notes that on August 11, 2020, the license holder sold alcohol to an underage person, without doing an age compliance check.

 

Speaking on behalf of the license holder is George Lough, Esq., 469 Centerville Road, Warwick, RI.

 

Mr. Lough states that this was a one-off event.

 

He notes that Ms. Noriega has 15 years of experience in the restaurant business.  All the employees are TIPS certified. The employee who sold the alcohol has been spoken to. 

 

Also speaking is Patricia Noriega, 225 Marjoram Drive, Cranston, RI., License holder

 

Ms. Noriega states that everyone who comes into the store now gets carded.

Upon motion by Councilor Wildenhain, seconded by Councilor Gregor, the board ACCEPTS THE PLEA OF NOLO CONTENDRE, BY CHRIS WINE & SPIRITS (CJ’S ENTERPRISES LLC), 1230 NEWPORT AVE.  LIC#14409, AND IMPOSES A FINE OF $500 TO BE PAID WITHIN 30 DAYS, WITH NO SUSPENSION, for the following reason, on a roll call vote, as follows:

 

On or about August 11, 2022:  Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).

 

AYES – Vice-Chairperson Mercer, and Councilors Araujo, DaRosa, Gregor, Schuette, Stachowiak, Vasquez and Wildenhain.

With majority consent of the Board, the following motion made by Councilor DaRosa, seconded by Councilor Wildenhain, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to send a communication to Bianca Policastro, Director of Planning and Redevelopment, and Anthony Ambrosino, Arts Festival Director, requesting that starting next year that the Kretcheu Festival be included as part of the Pawtucket Arts Festival.

THE CHAIR RECOGNIZES COUNCILOR SCHUETTE.

 

Upon motion made by Councilor Schuette, seconded by Councilor Gregor. The request from Mangos Hookah Lounge (Princess Investments LLC) 15 Exchange Street, to remove the stipulation requiring a police detail on Saturday nights is DENIED AND WILL BE REVIEWED AGAIN IN 60 DAYS, on a unanimous voice vote.

 

 

Communication from Captain Timothy Graham, Pawtucket Police, to Pawtucket Board of License Commissioners. (FabCity Cigar Lounge – Recommendation for police detail) is READ AND ORDERED FILED.

 

 

 

Review of DBR required Detail Officers at FabCity Cigar Lounge, 1438 Newport Avenue.

Stipulation.

1.     Two Police detail officers on weekend nights (Friday and Saturday nights) and any night before a State Holiday, as well as on a State Holiday.

THE CHAIR RECOGNIZES COUNCILOR DAROSA.

 

Upon motion made by Councilor DaRosa, seconded by Councilor Gregor, the review of DBR required Detail Officers at FabCity Cigar Lounge, 1438 Newport Avenue, is POSTPONED UNTIL SEPTEMBER 21, 2022 AND THE DETAIL OFFICERS WILL CONTINUE UNTIL THAT DATE.
