A regular session of the Pawtucket Board of License Commissioners is held Tuesday, November 22, 2022, at 6:49 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

 

Present – President Moran, Councilors Araujo, DaRosa, Gregor, Mercer, Schuette, Stachowiak, Vasquez and Wildenhain.

 

Absent – 0.

 

Chairperson Moran presides.

 

 

The reading of the records of November 9, 2022 is dispensed with and the records are APPROVED as prepared by the Clerk,

 

 

Upon motion made by Councilor Mercer, seconded by Councilor Araujo, the *Consent Agenda is APPROVED, on a unanimous voice vote.

Speaking in favor is Attorney Michael F. Horan, 393 Armistice Boulevard, Pawtucket, RI.

 

Mr. Horan states that the business has been in the Culpo family for 33 years. The father is passing on the business to his son and daughter-in-law.

 

They wish to switch from a Class D Club to Class BV liquor license with food.

 

Speaking is Peter Culpo, Jr. 153 Albert Avenue, Cranston, RI, applicant.

 

Mr. Culpo states that he has been in the hospitality business for 14 years.  He will be operating the business the same as now.

 

The hours will be Monday thru Saturday from 11:00 a.m. until 1:00 p.m. and Sunday from 12:00 p.m. until 1:00 a.m.

 

There will be eight employees.

 

It will be a neighborhood bar. They will have outdoor cookouts in the summer.

 

Mr. Culpo and his wife will be running the business.

 

The zoning is grandfathered; it’s in an RM zone.

 

They will serve bar food.

 

He will spruce up the place.

 

Capacity is 72. There is a juke box. He may do entertainment outside.

 

They will keep current customers and bring in new ones. There is sufficient parking.

 

There is no kitchen.

 

Attorney Horan states that they will keep going with Class D License until they meet all the requirements for a BV License, including approval by Department of Health on a kitchen.

 

Speaking is Melanie Tatro, owner of property across the street.

 

Ms. Tatro states that she is concerned about this expansion.

 

Ms. Tatro states that there have been drug transactions, prostitution and urination in front of her house.  People are outside all night long. The parking is limited.

 

She cannot get a tenant for the second floor of her house.

 

She has two kids.

 

She states that the business needs security outside.  She last called the police about a year and a half ago.  In recent times, public urination is still a problem.

 

She states that she is speaking for her neighbors.

 

Mr. Horan states that Peter, the son, will give his contact information to Ms. Tatro so she may contact him if there is a problem.

 

Mr. Culpo states that there is no problem to have someone watch the activities outside. He notes that the issues spoken about are all around neighborhood. 

 

Councilor DaRosa suggests putting up “no loitering” signs.

 

Councilor Araujo suggests adding outdoor cameras.

 

There are no other speakers. The hearing is closed.

Upon motion made by Councilor Mercer, seconded by Councilor Araujo, the following license is APPROVED, PENDING ALL REQUIREMENTS FOR ISSUANCE OF THE CLASS B (VICTUALER) LIQUOR LICENSE ARE MET WITHIN SIX MONTHS OF THE APPROVAL DATE BY THE PAWTUCKET BOARD OF LICENSE COMMISSIONERS.  IF NOT, THEN THE APPLICANT MUST APPEAR ONCE AGAIN BEFORE THE BOARD FOR FURTHER CONSIDERATION ON THE LICENSE.  (Until then, they may continue to operate as a Class D establishment), on a unanimous voice vote:

THE CHAIR RECOGNIZES COUNCILOR MERCER.

 

With majority consent of the Board, the following motion made by Councilor Mercer, seconded by Councilor Wildenhain, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to issue a summons to Pawtucket Patriot Bar and Grill, to appear at an INFORMAL HEARING on Wednesday January 11, 2023, for the following reason:

 

1.  On or about October 24, 2022:  Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where they are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood, said disorderly behavior which included, but is not limited to a fight in the parking lot of the licensed premises; and/or permitting any of the laws of this state or ordinances of this city to be violated.  (Violation of R.I. Gen. Laws § 3-5-23).

 

 

Communication from Tina Goncalves, Chief of Police, to the Pawtucket Board of License Commissioners.  (Response – Compliance Checks for Opening Times for Liquor Stores) is READ AND ORDERED FILED.

 

 

In conformity with Section 5-22-3 of the General Laws of Rhode Island, Class B liquor establishments are hereby entitled to remain open on New Year’s morning, January 1, 2023, until 3:00 a.m.  Alcoholic beverages CANNOT be sold after the usual closing hour of 1:00 a.m.
