A regular session of the Pawtucket Board of License Commissioners is held Wednesday, May 11, 2022, at 6:53 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

Present – President Moran, Councilors Araujo, DaRosa, Gregor, Mercer, Schuette, Stachowiak and Wildenhain.

Absent – Councilor Vasquez.

Chairperson Moran presides.

Present on behalf of the City of Pawtucket is Frank J. Milos, Jr., Esq., City Solicitor.

Mr. Milos states that an offer was extended to the license holders:

For the incident on March 26, 2022, a fine of $500.00 would be imposed with entertainment ending at 12:00 a.m. for 30 days, for continuing entertainment after hours, plus an additional $500.00 fine would be imposed for allowing open containers outside.

For the incident on April 11, 2022, a fine of $500.00 would be imposed for allowing open containers outside.

Speaking is Alex Quiroz, 126 Edgeworth Avenue, Providence, RI, and Wilson Soto, 241 Cottage Street, Woonsocket, RI, who are sworn-in by City Clerk Richard J. Goldstein.

Mr. Soto pleads No Lo, but states that the facts are vague.

Mr. Soto states that they hired a new security company.

He states that patrons have anxiety when the music stops. Some people sneak alcohol outside.

He has two lines of security; one inside and one outside. He states that they cannot pat down people on the way out because there isn’t enough time.

The Board expresses their feelings about the license holders taking responsibility for what happens at their establishment

The hearing is closed.

THE CHAIR RECOGNIZES COUNCILOR STACHOWIAK.

Upon motion made by Councilor Stachowiak, seconded by Councilor Mercer, the board IMPOSES THE FOLLOWING:

FOR CONTINUING ENTERTAINMENT AFTER HOURS ON MARCH 26, 2022, A FINE OF $500.00 WITH ENTERTAINMENT ENDING AT 12:00 A.M. FOR 30 DAYS, BEGINNING ON JUNE 13, 2022,

FOR ALLOWING OPEN CONTAINERS OUTSIDE ON MARCH 26, 2022, A FINE $500.00.

FOR ALLOWING OPEN CONTAINERS OUTSIDE ON APRIL 11, 2022, A FINE OF $500.00.

THE $1,500 IN TOTAL FINES IS TO BE PAID WITHIN 90 DAYS.

for the following reasons, on a unanimous voice vote:

On or about March 26, 2022: Entertainment after hours. Violation of Pawtucket Ordinance § 260-14 entitled “Licensing Regulations – Hours of Operations”

On or about March 26, 2022: Consumption of alcoholic beverages outside of the licensed premises, in violation of RIGL § 3-5-9 entitled “Premises Covered”, Rule #27 of the RI Department of Business Administration Handbook “Commercial Licensing Regulation 8 Liquor Control Administration” and § 108-14 of Pawtucket Code of Ordinances, which prohibits alcoholic beverages from being consumed on City streets and sidewalks.

On or about April 11, 2022: Consumption of alcoholic beverages outside of the licensed premises, in violation of RIGL § 3-5-9 entitled “Premises Covered”, Rule #27 of the RI Department of Business Administration Handbook “Commercial Licensing Regulation 8 Liquor Control Administration” and § 108-14 of Pawtucket Code of Ordinances, which prohibits alcoholic beverages from being consumed on City streets and sidewalks.

THE CHAIR RECOGNIZING COUNCILOR MERCER.

With majority consent of the Board, the following motion made by Councilor Mercer, seconded by Councilor Araujo, is PASSED on a unanimous voice vote:

The Clerk is instructed to issue a summons to Vibe Lounge and Hookah Bar, 23 Broad Street, to appear at a FORMAL HEARING on Wednesday, May 25, 2022, for the following reason:

On or about April 17, 2022: Failure to maintain control of patrons and/or employees, agents; endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state or ordinances of this city to be violated in the neighborhood.
