A regular session of the Pawtucket Board of License Commissioners is held Wednesday, June 22, 2022, at 6:55 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. Video

 

Present – President Moran, Councilors Araujo, DaRosa, Gregor, Mercer and Wildenhain.

 

Absent – Councilors Schuette, Stachowiak and Vasquez.

 

Chairperson Moran presides.

Stipulation.

1.     Close at 12 Midnight, Sunday through Wednesday, and at 1:00 a.m., Thursday through Saturday.

 

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., City Solicitor.

 

Mr. Milos states that a formal hearing will not be necessary if the Board approves a disposition on this matter, which has been worked out with the license holder.  The license holder will plead No Lo, pay a $1,000.00 fine, which is to be paid within 30 days and agree to a four-day suspension.  The suspension will be stayed for six months. If, during that time, there is a need to impose the suspension, it would be two consecutive Fridays/Saturdays. The suspension would be imposed only if there is another incident.

 

Representing the Tikal Restaurant & Lounge is Attorney Nick Hemond, 1 Turkshead Place, Providence, RI.

 

Mr. Hemond states that this is more of a restaurant than a nightclub. Nothing like this has happened before. He is not sure of added security. This is not that kind of place where a pat down is needed.

 

He can get information to Board on a later date.

THE CHAIR RECOGNIZES COUNCILOR MERCER.

 

Upon motion made by Councilor Mercer, seconded by Councilor Wildenhain, the Board ACCEPTS THE PLEA OF NO LO CONTENDERE AND IMPOSES ON THE LICENSE HOLDERS OF TIKAL RESTAURANT & LOUNGE (INTERNATIONAL CLUB & BILLAR INC) 139 BROAD STREET, A FINE IN THE AMOUNT OF $1,000.00 TO BE PAID WITHIN 30 DAYS, AND A FOUR-DAY SUSPENSION, TO BE STAYED FOR SIX MONTHS.  IF THERE IS ANOTHER INCIDENT WITHIN THAT TIME, THE SUSPENSION FOR THE MAY 8, 2020 INCIDENT WILL CONSIST OF TWO CONSECUTIVE FRIDAYS AND SATURDAYS, for the following reason, on a unanimous voice vote:

 

1.     On or about May 8, 2022: Failure to maintain control of patrons and/or employees, agents, endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provision of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state or ordinances of the city to be violated in the neighborhood.

 

THE LICENSE HOLDERS WILL ALSO PROVIDE INFORMATION ABOUT IMPROVING SECURITY AT THE ESTABLISHMENT TO PREVENT PEOPLE BRINGING WEAPONS INTO THE RESTAURANT IN THE FUTURE.
