A regular session of the Pawtucket Board of License Commissioners is held Wednesday, February 23, 2022, at 6:50 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. Video

 

Present – President Moran, Councilors Araujo, DaRosa, Gregor, Mercer, Schuette, Stachowiak, Vasquez and Wildenhain.

Upon motion made by Councilor Mercer, seconded by Councilor Araujo, the agenda is amended to include the following Order from the Department of Business Regulation;

THE CHAIR RECOGNIZES COUNCILOR MERCER.

 

Upon motion made by Councilor Mercer, seconded by Councilor Araujo, the following Order from the Rhode Island Department of Business Regulation, (FabCity Cigar Lounge, 1438 Newport Avenue - Stay of Revocation) with the following stipulations is READ AND ORDERED FILED:

 

STIPULATIONS.

  1. Stay will be conditioned on an 11:00 p.m. closing every night and police detail (two-person) at night approximately 9:00 p.m. to midnight on Friday and Saturday nights and any night before a State Holiday and State Holidays.
  2. Furthermore, prior to the Appellant beginning to serve alcohol again, the Appellant must provide the Board with its written safety plan, including violence prevention and response procedures and notify the Board of a contact person responsible for ensuring the plan has been implemented.

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.

 

With majority consent of the Council, the following motion made by Councilor Wildenhain, seconded by Councilors Schuette and Stachowiak, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to send a communication to Tina Goncalves, Chief of Police and Captain David Holden, requesting that when Fab City reopens to selling alcohol per the DBR stay order, that your officers go by the establishment after the 11:00 pm closing time on those nights when there aren’t already detail officers there to make sure they are in compliance with the order. It is the Board’s understanding that like a 1:00 a.m. closing, last call must be at 10:45 p.m., all patrons must be out of the establishment at 11:20 p.m. and all employees must be out at 11:30 p.m.   

 

 

 

THE CHAIR RECOGNIZES COUNCILOR ARAUJO.

 

With majority consent of the Council, the following motion made by Councilor Araujo, on behalf of Council President Moran, seconded by Councilor Vasquez, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to send a communication to the RI Department of Revenue, Division of Taxation, to request that they hold an investigation of FabCity Cigar Lounge, 1438 Newport Avenue, to determine if they are meeting the revenue requirements of a smoking bar pursuant to state law.

 

The Board understands that the Division of Taxation cannot provide confidential taxpayer information on the establishment.  However, they are hopeful that the Division can and will keep the Board updated on the status of the investigations and will be able to provide them with the results of the investigation, including any penalties assessed for any violations that are found.
