A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 20, 2022, at 6:59 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. Video

 

Present – President Moran, Councilors Araujo, DaRosa, Schuette, Stachowiak, Vasquez and Wildenhain.

 

Absent – Councilors Gregor and Mercer.

 

Chairperson Moran presides.

Speaking in favor is Jose Jacome, 26 Capital Street, Pawtucket, RI, applicant.

 

Also present is Oscar Pozuelos, 2730 Hartford Avenue, Johnston, RI.

 

Mr. Jacome states that this will be a breakfast – lunch restaurant, with the potential for serving dinner, as well.  There will be a mixed menu, with an American breakfast, and some Greek, and Italian dishes.

 

The hours will be 7:00 a.m. until 9:00 p.m., Tuesday thru Sunday.

 

There will be eight or nine employees, if open for dinner.

 

Mr. Jacome worked at Pizzico on Hope Street.

 

He spoke to about seven people in the area and they are ok with the restaurant because he will not be open late, and there will be no entertainment.

 

The restaurant will seat 48 people. He has six parking spots in the back lot and street parking.

 

He will replace the kitchen floor, and clean inside.

 

He will do most shopping himself. Delivery trucks will park in the street, but he may have them pull into the lot on Mondays when he is closed.

 

Everyone will be tips certified.

 

The capacity is less than what Don’s had.

 

 

Speaking is Marty Bourgault, 8 Ordway Street, Pawtucket, RI.

 

Mr. Bourgault has a problem with a liquor license, but is ok with a restaurant selling food.

 

He is concerned about parking spaces in the back for upstairs units. He already has a problem with Café Ordway.

 

 

Speaking is Suzanne Bourgault, 8 Ordway Street, Pawtucket, RI.

 

Ms. Bourgault states that you don’t need alcohol if there is good food.

 

She notes the problems with Café Ordway; drugs being sold and swearing in the lot.

 

 

 

Speaking is Joao Gomes, 167 Benefit Street, Pawtucket, RI.

 

Mr. Gomes owns the fish market nearby.  He has parking in the back of his store. He had problem with Don’s Lunch with people from the restaurant that parked in his lot.

 

He is ok with food to go and the restaurant, but not liquor.

 

There had been problems with shootings in that area because of liquor.

 

There are no other speakers. The hearing is continued.

With majority consent of the Board, the following motion made by Councilor Stachowiak, seconded by Councilor Schuette, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to issue a summons to Mangos Hookah Lounge, 17 Exchange Street, to appear at a FORMAL HEARING on Wednesday, May 11, 2022, for the following reason: Video

 

On or about March 26 and April 11, 2022:  Failure to maintain control of patrons and/or employees, agents, endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state or ordinances of the city to be violated in the neighborhood.

 

On or about March 26 and April 11, 2022:  Consumption of alcoholic beverages outside of the licensed premises, in violation of RIGL § 3-5-9 entitled “Premises Covered”, Rule #27 of the RI Department of Business Administration Handbook “Commercial Licensing Regulation 8 Liquor Control Administration” and § 108-14 of Pawtucket Code of Ordinances, which prohibits alcoholic beverages from being consumed on City streets and sidewalks.

 

On or about March 26, 2022: Entertainment after hours.  (See attached police Report) Violation of Pawtucket Ordinance § 260-14 entitled “Licensing Regulations – Hours of Operations”
