A regular session of the Pawtucket Board of License Commissioners is held Wednesday, March 10, 2021, at 6:46 p.m., via videoconference on ZOOM during the COVID-19 pandemic, per Governor’s order 21-21.

Present – Chairperson Moran, Councilors Amponsah, Araujo, DaRosa, Mercer, Schuette, Vasquez and Wildenhain.

Absent – Councilor Rudd.

Chairperson Moran presides.

The reading of the records of February 24, and March 1, 2021 is dispensed with and the records are APPROVED as prepared by the Clerk, on a roll call vote, as follows:

AYES – President Moran, Councilors Amponsah, Araujo, DaRosa, Mercer, Schuette, Vasquez and Wildenhain.

NOES – 0.

Upon motion made by Councilor Mercer, seconded by Councilor Wildenhain, the agenda is amended to include the following claim, on a unanimous voice vote:

Communication from Sinapi Law Associates, Ltd., to the Pawtucket Board of License Commissioners, objecting to the transfer of the Class B (Victualling) License of Mangos (Princess Investments LLC) 17 Exchange Street, in the total amount of $2,015.32, on behalf of Rhode Island Distributing.

Upon motion made by Councilor Rudd, seconded by Councilor Wildenhain, the following claim is READ AND ORDERED FILED on a roll call vote, as follows:

AYES – President Moran, Councilors Amponsah, Araujo, DaRosa, Mercer, Schuette, Vasquez and Wildenhain.

COUNICLOR RUDD ARRIVES AT 6:51 P.M.

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR A LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP (The public was allowed to participate electronically):

CLASS B (VICTUALLER) Transfer 51% of stockholders –

Mangos (Princess Investments LLC) 17 Exchange Street, LIC#14600® (ent)

Speaking in favor is Alex Quiroz, 126 Edgewood Avenue, Providence, RI, applicant.

Mr. Quiroz purchased the business in November.

He has been learning the business. He is ready to be open more days. He is doing Pop-Ups.

He has a pay plan for the money that he owes to Rhode Island Distributing. That is why he is surprised by the Sinapi letter.

He is also surprised by the tone of the police letter. He says that on the night of the incident, the film shows that the police only knocked on their door once, not for several minutes as stated in the letter. He states that the film of the night differs in other ways from the letter.

The restaurant will be a full-service restaurant and bar. He plans to do catering downstairs.

The hours will be 6:00 a.m. to 1:00 a.m. He will do Pop-Ups from 2:00 p.m. until whenever the law requires him to close.

Parking is in the public garage and on the street; they also can park in the Exchange Street, Café lot.

Mr. Quiroz also works at Atrium on Main.

Mr. Wilson Soto also works there and is present at the meeting. Mr. Soto currently helps run Mike’s Kitchen in Cranston. Mr. Quiroz and Mr. Soto are both in the military.

They brought in a higher end menu. They want people to be safe and have a good time.

There are no other speakers.

With majority consent of the Board, the following motion made by Councilor Rudd, seconded by Councilor Mercer, is PASSED on a roll call vote, as follows:

The Clerk is instructed to issue a summons to Mangos (Princess Investments LLC) 17 Exchange Street, to appear at a FORMAL HEARING on Wednesday, March 24, 2021, for the following reasons:

On or about February 7, 2021: Operating after hours. (See attached police report.) (Violation of R.I. Gen. Laws § 3-7-7, Pawtucket Ordinance § 108-18 and Rule 1.4.18 of the RI Department of Business Administration – Liquor Control Administration entitled “Hours of Business – Retail”).

On or about February 7, 2021: Failure to comply with Governor’s Executive Order 21-11 (25) Closure of bar area at all times, ensuring the bar are is not accessible to patrons.

3. On or about February 7, 2021: Failure to comply with RIDOH Rules and Regulations pertaining to Safe Activities by Covered Entities During the COVID-19 Emergency (216-RICR-50-15-7) (“Safe Regulations”) (Violations of sections 7.4.1(A)(1)(a), 7.4.1(A)(3).
