A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 6, 2021, at 6:48 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.  

 

Present – Chairperson Moran, Councilors Amponsah, Araujo, DaRosa, Mercer, Rudd, Schuette, Vasquez and Wildenhain.

 

Absent – 0.

 

Chairperson Moran presides.

 

 

The reading of the records of December 21, 2020 is dispensed with and the records are APPROVED as prepared by the Clerk, on a roll call vote, as follows:

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR HEARINGS AT THIS TIME, IS TAKEN UP

EXPANSION OF PREMISE – Outdoor Seating – 10 x 20 area in front of building.

Speaking in favor is Attorney Michael Horan, 393 Armistice Boulevard, Pawtucket, RI and Tiffany Barreira, Applicant.

 

Mr. Horan states that the applicant is asking for a permanent outdoor expansion of premises to include a 10 X 20 ft patio, with 9 tables – 5 on patio and 4 adjacent to building.

 

Upon questioning by Attorney Horan, Ms. Barreira states that she has been there since 2018.

 

She has a breakfast and lunch business.

 

There are currently less than 20 seats inside.

 

There are 7 employees now, had as many as 10.

 

Had 8 X 10 patio since 2019, she expanded to 10 X 20 during summer.

 

The hours are 7:00 a.m. thru 2:00 p.m.

 

She had a problem with an enclosure she built – it was temporary to get thru pandemic.

 

There are 17 parking spaces.

 

She took the enclosure down.

 

She would like to start serving outside this March or April.

 

She would like a tent for the 10 X 20 patio.

 

She would like to serve more people.

 

 

There is no outdoor lighting or cooking and no use of the sidewalk.

 

She had problems with tents in the past.

 

Some cars double park on the streets, but not from her place.

 

The plans accommodate all zoning requirements.

 

 

Speaking is Mario Rosario, 117 Hillard Avenue, Warwick, RI.

 

Mr. Rosario would like to see added information; clarification on temporary structure would be helpful.

 

Speaking is Tereza Pereira, 79 Crest Drive, Pawtucket, RI.

 

Ms. Pereira is satisfied with what she heard.

 

She is concerned about parking next to the tent, because it blocks the view of people trying to drive out of her driveway.

 

Ms. Bareira removed sign that blacked view of street, she parks van there so people will see sign for her restaurant.

 

There are no other speakers.

Upon motion made by Councilor Schuette, seconded by Councilors Amponsah and Vasquez, the following Petition for Expansion of Premise is APPROVED with the following stipulation on a roll call vote, as follows:

Stipulation.

 

1.     Structure must be 4 feet from any property lines, no higher than 15 feet and have at least 15 feet away from the sidewalk on the Prospect Street side, per the Director of Zoning and Code Enforcement.
