A regular session of the Pawtucket Board of License Commissioners is held Wednesday, December 22, 2021, at 7:01 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

 

Present – President Moran, Councilors Araujo, DaRosa, Gregor, Mercer, Schuette, Stachowiak, Vasquez and Wildenhain.

 

Absent – 0.

 

Chairperson Moran presides.

 

 

The reading of the records of December 8, 2021 is dispensed with and the records are APPROVED as prepared by the Clerk,

 

 

Upon motion made by Councilor Mercer, seconded by Councilor Schuette, the *Consent Agenda is APPROVED, on a unanimous voice vote.

With majority consent of the Board, the following motion made by Councilor Stachowiak, seconded by Councilor Schuette, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to issue a summons to International Club and Billar, 327 Barton Street, to appear at a FORMAL HEARING on Wednesday, January 5, 2022, for the following reason:

 

1.     On or about November 26, November 27, and December 3, 2021:  Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or creating or causing a public nuisance; and/or permitting any of the laws of this state or ordinances of this city to be violated. (See attached report) (Violation of R.I. Gen. Laws § 3-5-21 and R.I. Gen. Laws § 3-5-23).

With majority consent of the Board, the following motion made by Councilor Stachowiak, seconded by Councilor Mercer, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to send a communication to John Hanley, Acting Director of Zoning & Code Enforcement, and William Sisson, Fire Chief, requesting that International Club & Billar, 327 Barton Street, be inspected after the recent issue with the non-operational bathrooms.

THE CHAIR RECOGNIZES COUNCILOR SCHUETTE.

 

With majority consent of the Board, the following motion made by Councilor Schuette, seconded by Councilor Wildenhain, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to issue a summons to 574 Restaurant and Hookah Lounge, 110 School Street, to appear at an INFORMAL HEARING on Wednesday, January 5, 2022, for the following reason:

 

Incident that occurred on or about November 26, 2021, which includes operating after the legally required closing time. (Violation of R.I. Gen. Laws § 3-7-7, Pawtucket Ordinance § 108-18 and Rule 1.4.18 of the RI Department of Business Administration – Liquor Control Administration entitled “Hours of Business – Retail”) and allowing entertainment to continue after the legally required stopping time (Violation of Pawtucket Ordinance § 260-14 entitled “Licensing Regulations – Hours of Operations)
