A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 7, 2021, at 6:55 p.m., via videoconference on ZOOM during the COVID-19 pandemic, per Governor’s orders up to and including 21-30. 
Present – Chairperson Moran, Councilors Araujo, DaRosa, Mercer, Russ, Schuette, Vasquez and Wildenhain.

Speaking is John Fields, 3 Lockbridge Street, Pawtucket, RI.
Mr. Fields asks the board members if they received the letters he emailed to them. He apologizes for the grammar errors in the letters.
Mr. Fields states that he has a very small restaurant. He states that when he first opened, everyone knew his chef; many people came, in which case there was a lot of alcohol. They immediately shut it down. He went after a family restaurant. They don’t have a bar crowd. They don’t have a drink crowd. It’s a family restaurant.
There are 30 seats in the place. With COVID, there are a lot less. The dining area is 20 x 20 with an 8 x 10 bar area. There are only four seats there and they are using only two.
He would like to have outdoor seating. There were no problems in the past; no drinking problems. He knows there have been some issues with someone urinating in front of a neighbor’s house. Mr. Fields lives next door to him. He mentions a back story that he doesn’t discuss. He spoke with Michelle (Deputy Clerk Michelle Hardy) a couple of months ago, who informed him that this has happened more than once, which he was not aware of. When the neighbor complained to him, the next morning he had a port-a-john installed. He is not saying that that will cure the problem, but he at least tried to address it.
He would like to have outdoor seating. When he first opened, he took all his parking spots and put out tables and chairs, which took all his parking, which caused congestion in the streets. He states that he has a backyard, which is almost 900 square feet. If he gets the license, he will put all the tables and chairs back there. It’s a fenced-in area. He will get all his parking back.
As for having an outdoor bar, he has a Quonset hut that has storage for the restaurant. He states that when they had outdoor dining, they set up a waitress station with a drink station out there, which he didn’t know was illegal; otherwise, he wouldn’t have done it. He states that they are just a small family restaurant and they are trying to survive.
Councilor Rudd states that awhile back there were a couple of incidents from the outdoor seating, so he put a pause on it. He was inclined to approve it tonight, but he got several calls from the neighbors. He wants the business to succeed, but he can’t approve this based on what happened in the past. He knows that you can’t always control all of your clientele. He states that if he didn’t get any calls and there were no problems since, he was going to approve it. But once he got the calls, he had to put the neighbors interests first. Therefore, he was not going to be able to approve this.
Mr. Fields states that there are seven houses on his street and six of them are his customers. There is one gentleman who has lived there his whole life. He is the only one who complains. No matter what Mr. Fields does right or wrong, he is going to complain.
Councilor Rudd states that he got complaints from four of the residents.

The Clerk is instructed to issue a summons to Punto Final Hookah Bar and Lounge (Punto Final LLC) 31 Summer Street, to appear at a FORMAL HEARING on Wednesday, April 21, 2021, for the following reasons:
1. On or about March 14, 2021: Operating after hours. (See attached police report.) (Violation of R.I. Gen. Laws § 3-7-7, Pawtucket Ordinance § 108-18 and Rule 1.4.18 of the RI Department of Business Administration – Liquor Control Administration entitled “Hours of Business – Retail”).

The Clerk is instructed to send a communication to Tina Goncalves, Chief of Police, requesting that she have a detail officer placed in the area around the intersection of Newport Avenue and Benefit Street, on Friday and Saturday nights, between the hours of 9:30 p.m. and 1:30 a.m., for a period of eight weeks, beginning on Friday, April 9, 2021. The cost of the detail should be paid with city funds. This request is in light of the recent shootings in the area.
