A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 10, 2018, at 6:54 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.  Video

 

Present – Chairperson Moran, Councilors Barry, Cano, Mercer, Rudd, Vitali and Wildenhain.

 

Absent – Councilors Kallman and Tetreault.

Mr. Lima states he is working with other Cape Verdean establishments on ways to improve safety.

 

Mr. Lima and his niece will manage the establishment.

 

He states that he has a parking agreement for the lot behind the building.  He will provide a copy of the agreement to the City Clerk’s Office when he picks up the license.

FORMAL HEARING ON THE FOLLOWING LICENSE IS TAKEN UP: Video

Polish-American Citizens’ Club, 244 Annie St. LIC#4065 #3535

 

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., City Solicitor.

 

Mr. Milos states that the license holder has agreed to enter into a plea of Nolo Contendre for a first offence, which usually results in a $250.00 fine and no suspension. Mr. Milos states that this is due to an incident on November 17, 2017.

 

Also present is Scott Spychalla, 318 Daggett Avenue, Pawtucket, RI., representing the Polish-American Citizens’ Club.  Mr. Spychalla is sworn-in by the City Clerk

 

Mr. Spychalla apologizes.  He states that Captain Newman recommended that they call the police if cars will be there all night.  He states that they will be sensitive to the needs of neighbors.

THE CHAIR RECOGNIZES COUNCILOR MERCER.

 

Upon motion made by Councilor Mercer, seconded by Councilor Barry, the Council ACCEPTS THE PLEA OF NOLO CONTENDRE AND ORDERS THE LICENSE HOLDER TO PAY A $250.00 FINE BY THE END OF FEBRUARY 2018 for the following reasons:

 

 

 

1.     On or about November 18, 2017: Operating after hours. (Violation of R.I. Gen. Laws § 3-7-7, Pawtucket Ordinance § 108-18 and Rule 18 of Liquor Control Administration)

 

2.     On or about November 18, 2017:  Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).
