Speaking in favor is Roger Ross, Esq. 150 Main Street, Pawtucket, RI.

 

Also present is Rafael Barahona, 12 Middle Street, Pawtucket, RI, applicant.

 

Mr. Ross states that Mr. Barahona plans to run a neighborhood bar.  He understands that there were problems under the prior owner.

 

Mr. Ross states that at the request of PCF Development, who owns the next property, he emailed them a copy of deed showing that Mr. Barahona owns the property.

 

Mr. Ross notes that the neighbors are concerned about loitering, so the applicant agrees to police details on weekends.  There are concerns about smoking on the sidewalk, so the applicant will post someone outside to ensure there is no smoking in the area around the building.  There are concerns about trash, so the applicant will remove trash to an off-site location every night.  The lot is too small to have a dumpster on it.

 

Mr. Ross states that the applicant has his TIPS certificate and food service certificate.  He has done all he needs to do.

 

He states that the applicant plans to be on the premises at all times.  However, if he is away, his brother will fill in for him.  He will have only one employee.

 

For parking, the applicant has a lease for 16 undesignated parking spaces on a lot in Central Falls, right over the Pawtucket line, about 400 feet away from the building.

 

The hours will be from noon until midnight, seven days per week.

 

Upon questioning from the Council, Susan Mara, Acting Director of Planning and Redevelopment, states that a dumpster is required on the property; however, there may be grandfather rights in this case.

 

Mr. Barahona states that he will have security there.  He is OK with a police detail.

 

Upon questioning from the Council, Mr. Ross states that he believes that the prior business has been closed for about a year, maybe a little longer.

 

Mr. Ross states that food at the bar will be limited.  There will be no cooking on-site.  They will buy food already cooked and they will reheat it on site.  The bar does not have a kitchen.

 

Mr. Barahona states that his customer base will be the Latin population.

 

Mr. Ross states that the bar will have a pool table and a juke box.  There will be no live entertainment.

 

Upon questioning from the Council, Mr. Ross states that the parking lot is open to all.  There is no guarantee of available spaces.

 

Mr. Ross believes that capacity in the building is 43 seats, including the bar area.

 

Upon questioning from the Council, Mr. Barahona states that a bar is the only plan for the building.  He states that originally he had someone who planned to sell real estate from there, but he backed out.

 

Speaking against the application is Linda Weisinger, from PCF Development, 204 Broad Street, Pawtucket, RI.

 

Ms. Weisinger reads from a prepared statement, which is made part of the file.

 

Also speaking against the application is James Ruthowski, from the Pawtucket Housing Authority, regarding 175 Broad Street, Pawtucket, RI.

 

Mr. Ruthowski states that when the bar was open, bar customers parked in the Kennedy Plaza lot at 175 Broad Street, taking away parking from tenants and visitors.  There were concerns about noise.  The place was an anchor for ladies of the evening.

 

He notes that the tenants at Kennedy Plaza are elderly and disabled people.

 

He states that the neighborhood has changed; it is very nice now.

 

Also speaking against the application is Matty Hathor, 175 Broad Street, Pawtucket, RI.

 

Ms. Hathor does not believe that a bar is needed there.

 

She states that she was part of the problem.  She has since changed her life.

 

She notes that the area has been cleaned up. 

 

She is concerned that a bar there would bring back the old problems.

 

 

Also speaking against the application is Amanda Carr, House of Hope Project Manager, 185 Dexter Street, Pawtucket, RI.

 

Ms. Carr runs the Access Program at the House of Hope.

 

She states that she came to the area in 2011 and the bar was already closed.

 

The area has now become a neighborhood.

 

The bar would be devastating to her clients.

 

She notes that families live near the bar.

 

She is concerned that the bar would attract a negative element.

 

She believes that if trash is cleaned up at 1 or 2 a.m., it would create noise.

 

 

Also speaking against the application is Desiree Domenech, 204 Broad Street, Pawtucket, RI.

 

Ms. Domenech states that PCDC has changed the streets.  It is now livable.

 

There were lots of problems when the bar was there.

 

She is concerned about children in the area.

 

 

Also speaking against the application is Lori Barden, 29 Cherry Street, Pawtucket, RI.

 

Ms. Barden has lived at that address for 42 years.

 

She notes that there are three sober houses in the neighborhood.

 

She shows pictures taken last Sunday showing two people sleeping on the street.

 

She states that she ran a clean-up of the tot lot area, where they picked up a lot of cigarettes.

 

On another clean-up, she states that it took 30 people 2½ hours to pick up all the trash.

 

She is concerned about congestion and drunk drivers.

 

 

Also speaking against the application is Wilma Smith, 28 Darrow Street, Pawtucket, RI.

 

Ms. Smith states that she is on the Board of PCFD.

 

She notes that there are already two other bars in the area.

 

She was horrified by the number of streetwalkers there were when she first moved to Barton Street.

 

They have worked to bring in programs for kids and a bar would bring the neighborhood down.  She believes that the tot lot is a huge addition to the area.  She can walk up Barton Street to get there.  The bar would be right in the middle of her walk.

 

On parking for the bar, she states that there is already enough traffic going into the lot.

 

 

Also speaking against the application is Cassandra Smith, 28 Darrow Street, Pawtucket, RI.

 

Ms. Smith states that she has two children.  They use the tot lot.  They pass by the bar a lot to get there.  She does not believe that a bar is appropriate with so many kids in the area.

 

 

Also speaking against the application is Sandra Smith, 72 Clay Street, Central Falls, RI.

 

Ms. Smith states that she is 29 years sober.

 

She does not want the bar there.  She thinks it’s a bad idea.

 

She states that she is scared to walk to the store.

 

She believes it would be good to have something for kids.

 

 

Also speaking against the application is Freddy Contreras, 86 Barton Street, Pawtucket, RI.

 

Mr. Contreras states that over the past six years, there has been great improvement in the neighborhood.  A bar is not a good fit.

 

 

Also speaking against the application is Andrew Pierson, from PCF Development, 204 Broad Street, Pawtucket, RI.

 

Mr. Pierson submits three letters in opposition to the bar from Ligia Florez, Julie and Michael Taylor and Alicia Delgado, who reside in the neighborhood.  These letters are made part of the file.

 

Mr. Pierson states that he supports businesses, but a bar is not the right fit for that location.  He has concerns about noise, smoking and trash.

Ms. Arffa submits a statement which is filed with the liquor license.

 

Ms. Arffa states that she ran the bar and was not an employee of Hope Artiste Village.  She was told by them that she could not get her own license.  She operated under the umbrella of Hope Artiste Village’s license.

 

She believes that Hope Artiste Village skirts between legal and illegal activity

 

She bought liquor for her portion of establishment.

 

The bowling alley and the banquet area bought their own liquor.

 

The business was operated under a tenant/landlord memorandum, which was supposed to become a partnership.  It did not because she refused to sign the papers.

 

The rent included a base amount plus a portion of the gross sales.

 

She also stated that taxes were paid on the liquor.

 

 

Also present was Virginia Forbes, 399 Wayland Avenue, Providence, RI, in support of Phyllis.

 

She is here in support of Ms. Arffa.

 

She had business in the building, which was a café, no liquor.

 

 

Speaking is Michael Gazdacko, 1005 Main Street, Pawtucket, RI.

 

Mr. Gazdacko is a representative for Hope Spring Eternal.

 

He states that Hope Springs Eternal is the operator now.

 

He states that there had been two partnerships on 1st level.  They spoke with Mr. Horan, their attorney, on partnerships.  They weren’t trying to do anything illegal.  Since April 2016, there have been no partnerships.  All personnel are employees of Hope Springs Eternal.

 

He states that they were the responsible party if anything happened.

 

He states that right from the beginning, the plan was to open a restaurant, the bowling alley and a banquet hall.  The bowling alley would open first, then the restaurant and then the banquet hall.

 

He states that the documents with Ms. Arffa were not fully signed, so it was an implied partnership.

 

Ms. Arffa states that Hope Springs Eternal was supposed to pay opening costs, but they didn’t, which caused her to lose money.

2. There was a disparity between the Board hearing and the Department hearing over whether the Appellant plans to serve beer (imported) or not. The Appellant shall file with the Board within 30 days of this decision a written submission stating its plan regarding beer.

3. These conditions may be augmented by the Board, if necessary, because of new facts or circumstances.

4. The discovery by the Board that any of the testimony given at hearing was erroneous or constituted a misrepresentation of the facts presented would be grounds to revisit the granting of this License.

5. These conditions shall be reviewed by the Board upon any renewal application filed for the licensing period of 2011 to 2012 and the Board may decide to vacate all, some, or none on them upon granting (if granted) the renewal.13

6. The Appellant may file a request with the Board to lift the condition that it remains a smoking bar/cigar bar.14

He states that the former owner ripped out everything from inside the building.  All has been replaced.

 

He states that it will be calm environment.  They will be fixing the windows and changing the signs.  They will have a pool table and virtual golf game.

 

Capacity will be about 44 people.  There are 12 parking spaces.

 

By law over 50% of their revenue will come from tobacco.
