A regular session of the Pawtucket Board of License Commissioners is held Wednesday, February 24, 2016, at 7:57 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Moran, Councilors, Barry, Bray, Hodge, Mercer, Rudd, Tetreault and Wildenhain.
Absent – Councilor Cano.
Chairperson Moran presides.
The reading of the records of February 10, 2016 is dispensed with and the records are APPROVED as prepared by the Clerk.

Speaking in favor is Dave Williams, 38 Littlefield Street, Pawtucket, RI.
Mr. Williams states that there will be a police presence at the carnival.
There is a parking plan.
He states that they need to improve their fundraising.
He wants the event to be for all the children.
The money raised at the carnival will allow them to provide top notch services to their members.

Upon motion made by Councilor Hodge, seconded by Councilor Rudd, the following license is APPROVED, on a unanimous voice vote:

Mrs. Silakone and her mother will run the restaurant.
Her family ran a restaurant in California.
She will be the manager of the restaurant.
There will be no sitting bar.
All servers will be T.I.P.S. certified.
The hours will be 11:30 a.m. thru 2:30 p.m., and 4:30 p.m. thru 9:00 p.m., Monday thru Friday; 4:30 p.m. thru 9:00 p.m., on Saturday; and closed on Sunday.
The smell won’t bother the neighbors.
Mr. Letaourneau states that he will fix the fence around the dumpster.
Also speaking in favor is Kevin L. Miniati, 470 Newport Avenue, Pawtucket, RI.
Mr. Miniati states that he supports the application.

A FORMAL HEARING ON THE FOLLOWING LICENSE IS TAKEN UP:

Representing the City of Pawtucket is Frank J. Milos, Jr., City Solicitor.
Mr. Milos states that the license holder has agreed to enter into a plea of No Lo Contendre for a first offence, which usually results in a $250.00 fine and no suspension. Mr. Milos states that this is due to an incident on January 15, 2016, when a minor, who was working with police, was sold alcohol without being questioned about her age.
Also present is Rady Lim, 298 Pawtucket Avenue, Pawtucket, RI, license holder, and his attorney Joseph P. Casale, Esq., 438 East Main Road, Middletown, RI.
Mr. Casale states that Mr. Lim apologizes and it will not happen again.
Mr. Lim apologizes.
Councilor Barry asks if they need the time to pay the fine. Mr. Casale responds that Mr. Lim will pay the fine tomorrow morning.

THE CHAIR RECOGNIZES COUNCILOR BARRY.
Upon motion made by Councilor Barry, seconded by Councilors Mercer and Wildenhain, the Council ACCEPTS THE PLEA OF NOLO CONTENDRE AND ORDERS THE LICENSE HOLDER TO AY A $250.00 FINE TOMORROW IN THE MORNING, for the following reasons:
1. On or about January 15, 2016: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the licensed premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).
2. On or about January 15, 2016: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the licensed premises (Violation of R.I. Gen. Laws § 3-5-23).
