A regular session of the Pawtucket Board of License Commissioners is held Wednesday, May 6, 2015, at 7:51 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Moran, Councilors, Barry, Bray, Cano, Hodge, Mercer, Rudd, Tetreault and Wildenhain.
Absent – 0.
Chairperson Moran presides.

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., City Solicitor.
Also present is Captain Newman, Pawtucket Police.
Captain Newman states that he got a call on March 15, 2015 regarding seven or eight unregistered cars on the street and sidewalk, along with tires and debris.
The owner was told to move the vehicles, including the tow truck. The owner responded that he would tie himself to the tow truck. Eventually he moved the vehicles.
Captain Newman states that he got calls on other occasions, as well.
The vehicles have been moved.
Mr. Milos states that the license holder does not have a State Dealers License.
Also speaking is the license holder Angel Munoz, 42 Hillwood Street, Cranston, RI
Mr. Munoz is sworn-in by the City Clerk.
Mr. Munoz states that he tried to maintain everything cleanly. He is doing the best the he can do.
He states that he doesn’t sell vehicles from his lot.
Mr. Munoz states that he kicked out people he rented the lot to for a month, who sold cars on the internet.
He has been in business about a year.
Also speaking is the owner of the property, Kent DaRosa, 396 River Road, Lincoln, RI.
Mr. DaRosa is sworn-in by the City Clerk.
Mr. DaRosa apologizes for the tenant. He has addressed the issues with the tenant.
Mr. Darosa believes that you don’t need a State license to sell used vehicles if he has a City license, unless he wants dealer plates.

THE FOLLOWING LICENSE RENEWALS WERE POSTPONED AT THE MEETING HELD APRIL 8, 2015 AND ARE AGAIN TAKEN UP AND ARE APPROVED WITH THE FOLLOWING STIPULATIONS ON A UNANIMOUS VOICE VOTE:

STIPULATIONS.
1. All vehicles and parts must be kept inside or in rear of the building.
2. The lot must be kept clean.
3. The parking lot must be painted with lines to show parking spaces.
THE CHAIR RECOGNIZES COUNCILOR HODGE.
With majority consent of the Council, the following motion made by Councilor Hodge, seconded by Councilor Rudd, is PASSED on a unanimous voice vote:
The Clerk is instructed to send a communication to Kevin Rabbitt, Division of Motor Vehicles, regarding the need for a state license to sell used vehicles. A property owner testified at a hearing that if a city or town has a local license for the sale of used vehicles, then it is not necessary to get a state license unless the seller wants to use dealer plates. It is his contention that if the seller does not intend to use dealer plates, then he can sell used vehicles by virtue of the local license alone, without the need to get a state license. The Board is seeking the state’s opinion on this matter.
THE FOLLOWING PETITIONS FOR LICENSES ARE POSTPONED ON A UNANIMOUS VOICE VOTE: 
A. Communication from Victor C. Santos, President of Community Center Grupo Amigos Da Terceira Inc., 55 Memorial Drive, requesting permission to have feast of Saint Vincent de Paul and to serve food and alcoholic beverages, and have bands perform throughout the day, outside at 55 Memorial Drive, on Friday, September 11, 2015 from 7:00 p.m. to 11:00 p.m., Saturday, September 12, 2015, from 1:00 p.m. to 11:00 p.m., and Sunday September 13, 2015, from 11:00 a.m. to 9:00 p.m.
