A regular session of the Pawtucket Board of License Commissioners is held Monday, November 17, 2014, at 7:10 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairperson Moran, Councilors Barros, Barry, Hodge, Mercer, Rudd, Tetreault, Vitali and Wildenhain.

 

Absent – 0.

 

Chairperson Moran presides.

Mr. Milos states that the Council usually imposes a $250.00 fine with no suspension for a first offense.

 

Also present is Kenneth J. Dalby, 220 Old Great Road, North Smithfield, RI.

 

Mr. Dalby is sworn in by City Clerk Richard J. Goldstein.

 

Mr. Dalby states that he has been in business for 42 years and has never had an incident before.

THE CHAIR RECOGNIZES COUNCILOR HODGE.

 

Upon motion made by Councilor Hodge, seconded by Councilor Wildenhain, the City Council ACCEPTS THE PLEA OF NOLO CONTENDRE AND ORDERS THE LICENSE HOLDER TO PAY A $250.00 FINE, PAYABLE BY NOVEMBER 21, 2014, for the following reasons:

 

1.   On or about October 3, 2014:  Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).

 

2.   On or about October 3, 2014:  Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).

Mr. Milos states that he spoke with the owner of the business, Ralph T. Garner, and his attorney Ralph Ryan, and they are looking to dismiss count 2 and go forward with count 1, which occurred on October 9, 2014.

 

Mr. Milos states that there have been several police calls to the establishment.

 

Mr. Garner wants to plead No Lo.

 

Mr. Milos states that they will be no fine or suspension, but they will have a detail officer on Thursdays.

 

Present are Ralph Garner, 33 Olympia Avenue, Pawtucket, RI, owner of the business and his attorney Ralph Ryan, 1492 Newport Avenue, Pawtucket, RI.

 

 Mr. Garner is sworn in by City Clerk Richard J. Goldstein.

 

Attorney Ryan states that his client was running hip hop nights on Thursdays. He will not be doing that anymore. He will be changing from a night club to a sports bar beginning in January.

 

He spent $50,000 so far on his business, and will be spending more.

 

There are no other speakers.

Upon motion made by Councilor Hodge, seconded by Councilor Mercer, the City Council ACCEPTS THE PLEA OF NO LO CONTENDRE AND ORDERS THAT THE LICENSE HOLDER HIRE A DETAIL POLICE  OFFICER ON THURSDAYS BETWEEN THE HOURS OF 9:30 P.M. AND 1:30 A.M. BEGINNING THURSDAY, NOVEMBER 19, 2014, FOR THE FOLLOWING REASONS:

 

1.   On or about October 9, 2014:  Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).
