A regular session of the Pawtucket Board of License Commissioners is held Wednesday, May 21, 2014, at 7:30 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Councilors Barros, Barry, Hodge, Mercer, Rudd, Tetreault, Vitali and Wildenhain.
Absent – Chairperson Moran.
Vice Chairperson Hodge presides.
The reading of the records of May 7, 2014 is dispensed with and the records are APPROVED as prepared by the Clerk.

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:

Speaking in favor is Michael Horan, attorney for applicant, 393 Armistice Blvd., Pawtucket, RI.
Also present is applicant, Carlos Valverde, 200 Mainville Hill Road, Cumberland, RI.
Mr. Valverde states that he will be serving mostly Peruvian food.
He has a restaurant in Providence on Valley Street.
Councilor Barry states that he was informed by Mr. Valverde that there was one violation in the last ten years at the Providence restaurant.
Councilor Barry states that he asked Councilor Rudd, who is a police officer in Providence, about the Providence establishment and he was told that there have been many issues there, especially at closing.
Mr. Valverde states that he does have issues in Providence, particularly with people hanging out outside. His security has to send people home when the business is closing.
Councilor Barry asks about the capacity of the business in Providence.
Mr. Valverde states his Providence location has a capacity of about 50 patrons and the Pawtucket location is about 40. There will be a restaurant and lounge downstairs and upstairs will be the kitchen and bar.
Councilor Barry states that there have been other incidents in Providence including a possible shooting.
Councilor Barry states that the police department in Pawtucket is not as big as Providence’s and he is concerned that there is going to be a need for extra services to this establishment.
The hours will be Mondays through Saturdays from 12:00 p.m. to 1:00 a.m. Mr. Valverde states that he understands that there is no 2:00 a.m. closing in Pawtucket.
Councilor Barry asks is this is going to be restaurant or bar.
Mr. Valverde states that this will be a restaurant.
Councilor Barry asks how many patrons will be upstairs.
Mr. Valverde states that he thinks it’s about 20 patrons.
Councilor Barry asks what the Fire Department has determined.
Mr. Valverde states that he believes the capacity is about 30 patrons.
Upon questioning from Councilor Wildehain, Mr. Valverde states that he does have residents who live close to his Providence location.
Councilor Wildenhain states that the owner has responsibilities to the neighbors and he has assigned police details to some of establishments in his district that have similar issues.
Councilor Barry again questions the capacity.
Mr. Valverde states that it is 40 total, upstairs and downstairs. He states that the bar upstairs will have 10 stools and three tables with two chairs each.
Councilor Vitali is concerned about the capacity and wants to make sure that Mr. Valverde will not go over capacity or run this restaurant as a night club.
Mr. Valverde states that this will be a restaurant and neighborhood bar.
Councilor Vitali states that the Council could add stipulations to restrict entertainment on this license.
Speaking in opposition is Tonia Soares, 38 Pawtucket Avenue, Pawtucket, RI.
Ms. Soares is concerned about sleeping. She states she works late and would have a hard time sleeping if there were people hanging around when the establishment closes.
There are no other speakers.
