A regular session of the Pawtucket Board of License Commissioners is held Wednesday, July 9, 2014, at 7:36 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

Present – Chairperson Moran, Councilors Barros, Hodge, Mercer, Rudd, Tetreault, Vitali and Wildenhain.

Absent – Councilor Barry.

Chairperson Moran presides.

The reading of the records of June 25, 2014 is dispensed with and the records are APPROVED as prepared by the Clerk.

*THE FOLLOWING PETITIONS FOR LICENSES ARE APPROVED ON A UNANIMOUS VOICE VOTE:

THE PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:

CLASS A transfer -

Purvi LLC d/b/a Blackstone Wine & Spirits, (transfer from PLW-MA Inc., d/b/a Blackstone Wine & Spirits) 275 Newport Ave. LIC#9961

PREVIOUS STIPULATIONS:

1. There shall be no deliveries off or on the residential part of Courtney Avenue.

2. All deliveries will come on and off Newport Avenue.

3. Deliveries shall be made in a 24 foot or box truck or smaller truck.

4. Deliveries shall be approximately six (6) or seven (7) a week.

5. No deliveries between 11:00 a.m. to 2:00 p.m. and compliance with the local Noise Ordinance. *Per City Council 2/23/11: No deliveries after 5:00 p.m.

6. Signs shall be placed in parking lot about the delivery area and the lot shall be striped on its delivery route to prevent customer parking in the delivery route.

7. Customer traffic shall be kept out of delivery area.

8. Vendors shall be notified orally and in writing upon the Appellant relocating pursuant to this Decision of the delivery conditions on the License. e.g. box truck, use of Newport Avenue, etc.

9. Vendors shall be notified orally and in writing annually of said delivery conditions upon renewal of the License assuming such conditions are made part of the renewal.

PER LIQUOR CONTROL ADMINISTRATION 2/02/11

Present for the hearing is Richard Morneau, Esq., 38 North Court Street, Providence, RI, attorney for the applicant.

Also present are Vijaykumar Patel, 353 Wareham Street, Middleborough, MA and Purvi Patel, 22 Brown Street, Blackstone, MA, applicants.

Attorney Morneau states that both applicants have experience in the liquor business and are TIPS Certified. They understand that there are stipulations on this license and will run the business as it is now. He states that Mr. Patel owned a liquor store in Massachusetts.

There are no other speakers.

The Public Hearing is closed.

THE CHAIR RECOGNIZES COUNCILOR MERCER.

Upon motion made by Councilor Mercer, seconded by Councilors Hodge and Vitali, the agenda is amended to include the following claim, on a unanimous voice vote:

Communication from Paul J. Pisano, Esq., to the Pawtucket City Council Board of License Commissioners, submitting a claim on the liquor license transfer of PLW-MA, Inc. d/b/a Blackstone Wine & Spirits for Horizon Beverage in the amount of $83,218.04 and RI Distributing Co. in the amount of $76,728.79.

Upon motion made by Councilor Mercer, seconded by Councilors Hodge and Vitali, the following claim is READ AND ORDERED FILED:

Upon motion made by Councilor Mercer, seconded by Councilors Hodge and Vitali, the following petition for license is APPROVED with the following STIPULATIONS, SUBJECT TO THE PAYMENT OF ALL OUTSTANDING CLAIMS, on a unanimous voice vote:

Also present is Carlos Rodriguez, 665 Broadway, Pawtucket, RI, applicant.

Attorney Horan states that this is a 100% change in stockholders. There are no other changes to the business.
