Pawtucket Board of License Commissioners

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, March 7, 2012, at 7:14 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

Present – Chairperson Moran, Councilors Barros, Barry, Chadwick, Hodge, O’Neill, Tetreault, Vitali and Wildenhain.

Absent – 0.

Chairperson Moran presides.

The reading of the records of February 22, 2012 is dispensed with and the records are APPROVED as prepared by the Clerk.

THE FOLLOWING PETITION FOR LICENSE WAS LAID ON THE TABLE AT THE MEETINGS HELD JANUARY 11, 25, AND FEBRUARY 22, 2012, AND IS AGAIN TAKEN UP:

CLASS BV (Victualer) New

International Club & Billar d/b/a International Club & Billar, 327 Barton St. LIC#7792®

Applicant Alex Samayoa, 219 Webster Avenue, Providence, RI, is present. Also present is Mickey Tandon, 329 Barton Street, landlord at 327 Barton Street.

Mr. Tandon states that he is putting in a new fire box at the request of the fire marshal. It should be installed on Monday or Tuesday of next week.

Mr. Samayoa has drawn up plans for a third means of egress, which the fire marshal said was necessary to eliminate the need for a fire detail on Saturday nights. Mr. Tandon states that the fire marshal had approved the plans. The door will be installed in about a month.

Mr. Samayoa would like to be open by the end of the month.

Several board members express their concerns about approving this license before the fire box and the door are installed. They want the box installed before allowing them to open and they suggest limiting the number of people in the club to 220 (half capacity) until the door is installed.

Mr. Tandon notes that there are already two means of egress from the space and clubs have been run out of that space for years without problems. He reiterates that the third door is being put in simply to avoid the need for a fire detail officer.

Upon motion made by Councilor Chadwick, seconded by Councilor Wildenhain, the following application for license is LAID ON THE TABLE until all matters with the fire marshal are worked out, on a unanimous voice vote.

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS CONTINUED AT THE MEETING HELD FEBRUARY 22, 2012, IS AGAIN TAKEN UP:

CLASS T (Theater)

House of Mood, 461 Main Street a/k/a 24 Commerce Street, LIC#7859

Speaking in favor is Ron Wierks, landlord, 461 Main Street and Ed Eckard, 39 Hazel Street, Providence, RI.

Mr. Eckard states that he is representing the applicant. They plan on having one event per month. They have had a caterer serve the alcohol previously. There is a capacity of 150 people. They plan on hiring one person.

Mr. Wierks states that they do events for charity. There has been a police detail at events, but it is a sit down crowd. The applicant will teach dance and then they will do a show at the end of the month.

Major Bruce Moreau states that the last event was well run; however, they had women in pasties, which is a violation of the entertainment license. If they have a liquor license, they will probably not need a detail.

There are no other speakers.

A FORMAL HEARING ON THE FOLLOWING LICENSE IS TAKEN UP:

Great Entrepreneurial Endeavors Inc., d/b/a Gee’s Liquor, 400 Broadway LIC#5097

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., City Solicitor.

Captain Michael Newman of the Pawtucket Police Department is also present and is sworn in.

Captain Newman states that on January 15, 2012, the Police Department conducted a Liquor Control Compliance Check at Gee’s Liquor and he was accompanied by an underage person (19 years of age). The minor bought a six-pack of Coors Light. Mr. Anselmo Santos sold the alcohol and did not ask the age of the person nor did he ask for identification.

Mr. Santos was given a summons to appear.

Speaking on behalf of the licensee is John Anthony Santos, 10 Lookout Avenue, North Providence, RI, who is sworn in.

Mr. Santos states that he is ashamed to come back before the Council for a liquor violation. He will spend more time at the store and do more training. Mr. Anselmo Santos is his brother and has been working there the last 4-5 years.

Mr. Milos states that this is the licensee’s 5^th offense since 2001 for selling to minors.

THE CHAIR RECOGNIZES COUNCILOR HODGE.

Upon motion made by Councilor Hodge, on behalf of Council President Moran, seconded by Councilor Barry, THE LICENSE HOLDER IS ORDERED TO PAY A $1,000.00 FINE, PAYABLE BY FRIDAY, MARCH 9, 2012, AND THE LICENSE IS HEREBY SUSPENDED FOR A PERIOD OF TWENTY (20) DAYS BEGINNING ON SUNDAY, MARCH 11, 2012, UP TO AND INCLUDING FRIDAY, MARCH 30, 2012, for the following reasons:
