A regular session of the Pawtucket Board of License Commissioners is held Wednesday, February 8, 2012, at 6:59 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Moran, Councilors Barros, Barry, Chadwick, Hodge, O’Neill, Tetreault, Vitali and Wildenhain.
Absent – 0.
Chairperson Moran presides.
The reading of the records of January 25, 2012 is dispensed with and the records are APPROVED as prepared by the Clerk.
THE FOLLOWING PUBLIC HEARING AND APPLICATION FOR LICENSE WERE CONTINUED AT THE MEETING HELD JANUARY 11, 2012 AND ARE AGAIN TAKEN UP:

Councilor Chadwick states that he has concerns regarding noise, the back door not being kept closed, trash in the back yard and loitering in the back yard.
Mr. Baptista agrees to have bouncers keep a close watch on the back yard.

1. Police detail officer shall be required on each Friday and Saturday from 9:00 p.m. through 1:00 a.m. 9/21/11
Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., City Solicitor.
Also present are Major Bruce Moreau and Officer Keith Shillan, Pawtucket Police Department. Officer Shillan is sworn in by City Clerk Richard Goldstein.
Present on behalf of the license holder are President of Corina’s Pub, Inc., Corrine Collins Gorman, 4 Grouse Trail, Smithfield, RI and Vice President, Francis Booth, 300 Front Street, Apt. 208, Pawtucket, RI.
Officer Shillan states that on December 8, 2011, dispatch reported that a man was stabbed at Corina’s. He met Raymond Corbin at the scene and was told by him that his cousin had been stabbed. He saw a man sitting with a towel on his neck. The victim, Donald Lebron, stated that he was attacked when he went out to have a cigarette.
Officer Shillan spoke to the bartender, Melissa Walsh, who stated that they had served three patrons who then went out to have a cigarette. Later, the victim went out and got attached.
Officer Shillan spoke with the owner, Mr. Booth, who showed him the security video. Mr. Lebron stated that he believed he was cut with a box cutter. He was cut from the ear down the neck to the other side of the neck.
Officer Shillan states that the police were called at 12:41 a.m. They took five witness statements; there were other witnesses who refused to give statements.
Officer Shillan states that Mr. Lebron was angry and wanted to fight. He appeared glassy-eyed.
Mr. Milos states that the last problem at the establishment was in 2004, regarding many police calls regarding this establishment. This is the first time for this type of incident.
Mr. Booth states that the person doing the cutting was there for the first time. He did not know him at all. Ms. Collins Gorman states that the man was over 21 and was not drunk.
On Thursdays through Sundays they have a DJ and a doorman. Ms. Collins Graham called and asked for a detail on the Wednesday before Thanksgiving.
Mr. Milos states that the Supreme Court has ruled that liquor establishment owners are responsible for the actions of their patrons.
Councilor Vitali asks Major Moreau what he thinks about this matter.
Major Moreau states that the owners have been cooperative with the police. However, the clientele includes former convicts and gang members. He wouldn’t want his daughter in this place.
Mr. Booth states that they have taken certain types of alcohol off the shelves to discourage certain types of clientele.

THE CHAIR RECOGNIZES COUNCILOR CHADWICK.
Upon motion made by Councilor Chadwick, seconded by Councilor Barry, the license holder IS HEREBY SUSPENDED FOR A PERIOD OF SEVEN (7) DAYS, SPECIFICALLY THURSDAY, FEBRUARY 9, 2012; THROUGH AND INCLUDING WEDNESDAY, FEBRUARY 15, 2012; FOR THE FOLLOWING REASON:
1. Failure to maintain control of patrons and/or endangering the health, safety and welfare of the general public and/or permitting the place where you are licensed to sell beverages to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood and/or permitting any of the laws of this state to be violated in the neighborhood, specifically, on or about December 8, 2011 (See attached Police Narrative Report)
IT IS FURTHER ORDERED THAT THE FOLLOWING STIPULATION IS ADDED TO THE LICENSE:
A detail officer is required on Fridays and Saturdays in a marked car from 9:00 p.m. until 1:00 a.m.
Communication from Major Bruce Moreau, Pawtucket Police Department, to Pawtucket City Council, Board of License Commissioners. (Sale of Alcohol to Underage Persons – Great Entrepreneurial Endeavors Inc., d/b/a Gee’s Liquor, 400 Broadway) is READ AND ORDERED FILED.

Upon motion made by Councilor Vitali, on behalf of Council President Moran, seconded by Councilor Wildenhain, Great Entrepreneurial Endeavors Inc., d/b/a Gee’s Liquor, 400 Broadway, is herewith SUMMONED TO APPEAR AT A FORMAL HEARING SCHEDULED FOR FEBRUARY 22, 2012, for the following reasons:
1. On or about January 15, 2012: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).
2. On or about January 15, 2012: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).
