A regular session of the Pawtucket Board of License Commissioners is held Wednesday, September 21, 2011, at 7:07 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairperson Moran, Councilors Barros, Chadwick, Hodge, O’Neill, Tetreault, Vitali and Wildenhain.

 

Absent – Councilor Barry.

 

Chairperson Moran presides.

 

 

The reading of the records of September 7, 2011 is dispensed with and the records are APPROVED as prepared by the Clerk.

 

 

THE FOLLOWING COMMUNICATION WAS TAKEN UP AT THE MEETING HELD SEPTEMBER 7, 2011 AND IS AGAIN TAKEN UP:

 

Communication from Major Bruce Moreau, Pawtucket Police Department, to Pawtucket City Council. (Sale of Alcohol to Underage Persons – Pho Horns, 50 Ann Mary Street) is READ AND ORDERED FILED.

 

 

THE CHAIR RECOGNIZES COUNCILOR BARROS.

 

With majority consent of the Council, the following motion made by Councilor Barros, seconded by Councilors Hodge and O’Neill is PASSED on a unanimous voice vote:

 

The Clerk is instructed to issue a summons to Pho Horn’s Inc., d/b/a Pho Horn’s, 50 Ann Mary Street, to appear at a FORMAL HEARING on Wednesday, October 5, 2011, for the following reasons:

 

1.  On or about June 24, 2011:  Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).

 

2.  On or about June 24, 2011:  Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).

 

 

 

Communication from Nova Churrasqueira Restaurant J & M LTD., 434 Broadway, to Pawtucket Board of License Commissioners, requesting permission to serve food and alcoholic beverages and provide entertainment in the parking lot of 434 Broadway on Saturday, October 1, 2011 from 3:00 p.m. until 12:00 a.m. is READ AND ORDERED FILED and THE REQUEST IS APPROVED WITH THE FOLLOWING STIPULATIONS, on a unanimous voice vote:

 

STIPULATIONS:

 

  1. Area must be fenced in.
  2. Must use plastic cups and containers only.
  3. No music and other entertainment outside the building after 8:30 p.m.
  4. Hire a Pawtucket Police Office for detail between 8:30 p.m. and 12:30 a.m.
  5. The outside area must be cleaned up by 8:00 a.m. the next morning.

 

 

 

Communication from Francis J. Booth, President of Corina’s Pub Inc., 584 Smithfield Ave. (Requesting to modify the stipulation)

 

STIPULATION:

 

1.  Police detail officer shall be required on each Friday and Saturday from 9:00 p.m. through 1:00 a.m. is READ AND ORDERED FILED.

 

 

THE CHAIR RECOGNIZES COUNCILOR CHADWICK.

 

Upon motion made by Councilor Chadwick, seconded by Councilor Hodge, the Board APPROVES an amendment to the stipulation for Corina’s Pub Inc., 584 Smithfield Ave., as follows:

 

*STIPULATION

 

1.  Police detail officer shall be required on each Friday and Saturday from 9:00 p.m. through 1:00 a.m.

 

 

 

THE FOLLOWING PETITION FOR LICENSE IS APPROVED ON A UNANIMOUS VOICE VOTE:

Petition of O Fest RI to serve beer and wine at the October festival at Slater Mill on Friday September 30, 2011 from 6:00 p.m. to 11 p.m., Saturday, October 1, 2011 from 12 p.m., to 11:00 p.m., and Sunday October 2, 2011 from 12 p.m., to 6:00 p.m., LIC#7587

 

 

 

Upon motion made by Councilor Hodge, seconded by Councilor Chadwick, the meeting is adjourned at 7:14 p.m.
