October 5, 2011

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, October 5, 2011, at 7:23 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairperson Moran, Councilors Barros, Barry, Chadwick, Hodge, O’Neill, Tetreault, Vitali and Wildenhain.

 

Absent – 0.

 

Chairperson Moran presides.

 

 

The reading of the records of September 21, 2011 is dispensed with and the records are APPROVED as prepared by the Clerk.

 

 

A FORMAL HEARING ON THE FOLLOWING LICENSE IS TAKEN UP:

 

CLASS BV (Victualer)  -

 

*Pho Horn’s Inc., d/b/a Pho Horn’s, 50 Ann Mary St. LIC#4215® 

1. Alcohol cannot be served after 12 Midnight.

 

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., City Solicitor.

 

Also present is Teven Tran, 17 Pumgansett Street, Providence, RI, license holder.  Mr. Tran is sworn-in by the City Clerk.

 

Mr. Milos states that the license holder has agreed to enter into a plea of Nolo Contendre and if the Board chooses to accept the plea, he recommends a $500 fine and a three day suspension for this second offense.

 

Mr. Tran states that he is sorry for the mistake.  He states that he was away on his honeymoon when it happened.  He is putting signs on all the tables to remind the wait staff to check ID’s.  He states that all staff is TIPS certified.

 

Speaking in favor of the license holder is Paul Audette, 595 Mineral Spring Avenue, Pawtucket, RI.

 

Mr. Audette states that Mr. Tran was very important to making the Gala at the Arts Festival successful.

 

 

THE CHAIR RECOGNIZES COUNCILOR BARROS.

 

Upon motion made by Councilor Barros, seconded by Councilor Vitali, the Board ACCEPTS THE PLEA OF NOLO CONTENDRE AND ORDERS THAT PHO HORN’S INC., D/B/A PHO HORN’S, 50 ANN MARY STREET, LIC#4215 BE FINED IN THE AMOUNT OF $500.00 AND THE LICENSE IS HEREBY SUSPENDED FOR A PERIOD OF THREE (3) DAYS, SPECIFICALLY WEDNESDAY, OCTOBER 12, 2011; THURSDAY, OCTOBER 13, 2011; AND FRIDAY, OCTOBER 14, 2011; FOR THE FOLLOWING REASONS:

 

1.   On or about June 24, 2011:  Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).

 

2.   On or about June 24, 2011:  Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).

 

 

 

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE TRANSFER, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:

 

CLASS A – transfer of location

 

Bela Vista Liquors Inc., d/b/a Bela Vista Liquors, 593 Weeden Street (transfer of location from 239 Prospect Street) LIC#7561

 

Representing the owner is Jack Galvao, 6 Winterberry Road, Lincoln, RI.  

 

Mr. Galvao states that the license holder apologizes for not being able to attend this hearing because he is out of state.

 

Mr. Galvao states that there will be no renovations except painting.  There will be one full-time and two part-time employees.  The hours of operation will be 9:00 a.m. until 10:00 p.m. Monday through Saturday.  He is unsure of what the hours will be on Sundays.

 

There are no other speakers.

Upon motion made by Councilor Chadwick, seconded by Councilors Barros, Barry, and Wildenhain, the following license is GRANTED on a unanimous voice vote:

Petition of Saint Raphael Academy to sell beer and wine at an Alumni Gathering at 194 Walcott Street, on Saturday, November 19, 2011, from 7:00 p.m. to 11:00 p.m. LIC#7627

 

 

Upon motion made by Councilor Hodge, seconded by Councilor Chadwick, the meeting is adjourned at 7:40 p.m.
