A regular session of the Pawtucket Board of License Commissioners is held Wednesday, March 23, 2011, at 6:48 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairperson Moran, Councilors Barros, Chadwick, Hodge, O’Neill, Tetreault, Vitali and Wildenhain.

 

Absent  Councilor Barry.

 

Chairperson Moran presides.

 

 

The reading of the records of March 9, 2011 is dispensed with and the records are APPROVED as prepared by the Clerk.

 

 

 

THE PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE IS TAKEN UP:

 

CLASS A

 

Ramnarine Inc., d/b/a Lonsdale Liquors (transfer from Nova Sintra USA Inc., d/b/a Lonsdale Liquors Wine and Spirits) 465 Lonsdale Avenue, LIC#6774

 

Speaking in favor is applicant Wayne Ramnarine, 60 Ashley Street, Cranston, RI.

 

Mr. Ramnarine states that he has no experience working at a liquor store but has worked in the food business.  He will be working with his son, who is currently employed at Lonsdale Liquors.

 

He will have three employees and his hours of operation will be from 10:00 a.m. until 10:00 p.m. and Sundays from 12:00 p.m. until 6:00 p.m.  His son is on the only one with liquor store experience.  All of his employees are TIPS certified.  The Current owner will work with him for one month.

 

The next speaker is Nicholas Ramnarine, 161 Sabin Street, Pawtucket, RI.

 

Mr. Ramnarine states that he is the son of the applicant who works at Londasle Liquors.  He states that he ran a liquor store for two years prior to working at Lonsdale Liquors.

Communication from McLaughlin & Moran, Inc., to Pawtucket Board of License Commissioners, objecting to the transfer of Class A Liquor License of Nova Sintra USA Inc., d/b/a Lonsdale Liquors Wine Spirits to Ramnarine Inc., d/b/a Lonsdale Liquors, 465 Lonsdale Avenue, in the total amount of $5,477.76.

 

 

Upon motion made by Councilor Chadwick, seconded by Councilor Hodge, the following communication is READ AND ORDERED FILED:

SPHOD Inc., d/b/a Sullivan’s Publick House (transfer from Leonora R. Marques d/b/a Boulevard Tap) 572 Armistice Blvd., LIC#6691

 

Speaking in favor is applicant Jack Doherty, 342 East Avenue, Pawtucket, RI.

 

Mr. Doherty states that he wants to open a small Irish Pub similar to Doherty’s Irish Pub.  There will be entertainment only a couple of times a year.  The hours of operation will be from 11:00 a.m. until 1:00 a.m. Monday through Friday and 12:00 p.m. until 1:00 a.m. Saturday and Sunday.  The capacity for the establishment is 109.

 

Mr. Doherty submits a parking plan and the menu.  He explains that there is parking for 13 in the lot and there is also street parking.

 

Speaking in opposition is Robert Scanlon, 15 Malvern Avenue, Pawtucket, RI.

 

Mr. Scanlon lives across the street.  He states that under a prior owner there have been problems with parking, drinking in the lot, necking, and urinating.  He does not believe that there is enough parking.

 

 

The next speaker in opposition is Americo Disirio, 580 Armistice Boulevard, Pawtucket, RI.

 

Mr. Disirio states that he has the same concerns as Mr. Scanlon.  It was always a noisy location and 12:00 midnight is too late for them to be open, never mind 1:00 a.m.  There is no parking.  The back lot is used by the residential apartment dwellers.

 

The next speaker in opposition is Raymond Parris, 585 Armistice Boulevard, Pawtucket, RI.

 

 

Mr. Parris states that he has been a Pawtucket resident for 54 years and it not a good time for a bar in the neighborhood.  He states that there is no parking; there is only enough room for two cars.

 

Speaking again is Mr. Doherty, applicant.

 

Mr. Doherty states that he will use the parking lots in the front and back of the building.  One of the employees will live above the restaurant, who will monitor the lot and keep the front clean.  The parking has been approved by Zoning.

 

 

The next speaker in opposition is Robert White, 178 Slater Park Avenue, Pawtucket, RI.

 

Mr. White states that there were many problems with the previous owner.

 

 

Speaking in favor is John Sawyer, 44 Clyde Street, Pawtucket, RI.

 

Mr. Sawyer states that he lives near the East Avenue Café and there are no problems.  He feels that people will walk to this new establishment.

 

The next speaker in favor is Joseph Knight, 104 Lyman Street, Pawtucket, RI.

 

Mr. Knight states that Mr. Doherty runs a class operation on East Avenue and he won’t tolerate any problems.

 

 

The next speaker in favor is Janet Towner, 137 Tobie Avenue, Pawtucket, RI.

 

Ms. Towner is the Realtor for the current owner, Mrs. Marques.  She states that there are many other restaurants that have no lot for parking.

 

 

Speaking again is Mr. Doherty, applicant.

 

Mr. Doherty states that he expects the capacity will be reduced once all the tables are put in.  He will get creative with the parking issue.

Upon motion made by Councilor Wildenhain, seconded by Councilor Vitali, the following application for license is APPROVED on a unanimous voice vote:

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.

 

With majority consent of the Board, the following motion made by Councilor Wildenhain, seconded by Councilor Vitali, is APPROVED on a unanimous voice vote:

 

 

The Clerk is instructed to send a summons to Nova Churrasqueuira Restaurant J & M Ltd. d/b/a Nova Churrasqueira Restaurant, 434 Broadway, to appear at a FORMAL HEARING on Wednesday, April 6, 2011, for the following reasons:

 

1.   Violation of the following stipulation placed on your liquor license:

A DETAIL OFFICER MUST BE PRESENT ON ANY NIGHT THAT THERE IS ENTERTAINMENT

 

2.   Failure to maintain control of patrons and/or endangering the health, safety and welfare of the general public and/or permitting the place where you are licensed to sell beverages to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood and/or permitting any of the laws of this state to be violated in the neighborhood, on various dates.

THE FOLLOWING LICENSE IS UP FOR A REVIEW OF THEIR STIPULATIONS, AS ADDRESSED AT THE SEPTEMBER 8, 2010, MEETING AND IS AGAIN TAKEN UP:

 

*Garrity Pub & Restaurant, Inc., d/b/a Corinne’s Banquets, 67 Garrity St. LIC#4208 (entWW)

1.   One member of management shall be on duty at all times.

2.   Licensee shall immediately notify District Councilor of any changes at establishment.

3.   Pawtucket residents shall be given preference for employment.

4.   A detail officer shall be hired on Friday and Saturday evenings from 10:00 p.m. until 2:00 a.m. – when over 200 people are expected – a private detail may be used when less than 200 people are expected.

5.   No storage trailers shall be located on the premises.

6.   All doors must be kept closed at all times.

 

COUNCIL PRESIDENT MORAN STATES THAT ALL STIPULATIONS ARE TO REMAIN IN PLACE.  NO FURTHER ACTION IS TAKEN.

 

 

Communication from Stevan Simon, SIS Realty, Inc., owner, 605 Broadway, Pawtucket, to Richard J. Goldstein, City Clerk.  (No Lease Agreement for Unique Minority Corp), IS READ AND ORDERED FILED.

 

 

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.

 

With majority consent of the Council, the following motion made by Councilor Wildenhain, seconded by Councilors Hodge and Barros, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to issue a summons to Unique Minority Corp., d/b/a Yazel’s Bar & Grill, 605 Broadway, to appear at a FORMAL HEARING on Wednesday, April 6, 2011, for the following reason:

 

Notification from the property owner that you do not have a lease agreement at 305 Broadway, Pawtucket, RI and, therefore, the Class B liquor license in question does not have a Premises as required by R.I. Gen. Laws § 3-5-9 and also Rule 27 of the Commercial Licensing Regulations of the Department of Business Regulation.
