A regular session of the Pawtucket Board of License Commissioners is held Wednesday, September 8, 2010, at 6:58 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Councilors Barros, Barry, Chadwick, Hodge, Moran, Tetreault and Vitali.
Absent – Chairperson Kinch; Councilor Wildenhain.
Vice Chairperson Hodge presides.
COUNCILOR WILDENHAIN ARRIVES AT 6:59 PM.
The reading of the records of August 25, 2010 is dispensed with and the records are approved as prepared by the Clerk.
A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:
CLASS B (Victualer) – New
J & L Management LLC d/b/a Grille 47, 47 Mendon Avenue, LIC#5868
Present are David Graham, Esq., 1804 Mineral Spring Avenue, North Providence, RI, representing the applicant and Alfredo Lopes, applicant.
Councilor Wildenhain states that the transfer was not successful. This is a new license filed for this location.
Mr. Graham states that they have been working diligently with the City Clerk’s Office to turn in all the necessary paperwork for this license.
Mr. Lopes states that he hopes to run a family restaurant and is looking forward to operating with a clean slate.
Speaking in opposition is Jeanette and Ormando Aquino, 28 Carter Avenue, Pawtucket, RI., neighbors to Grille 47.
Mrs. Aquino states that they are people hanging around after hours. Is not the same as she remembers Archies, which was a family restaurant.
She also states that they have the karaoke and bands as a entertainment and is disturbing to the neighborhood.
Councilor Wildenhain states that this has been represented to be a family atmosphere and restaurant. He hopes that the problems of the past with noise and loitering do not repeat themselves.
Mr. Lopes and Mr. Graham guarantee no problems.

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
Upon motion made by Councilor Wildenhain, seconded by Councilor Barry, the following license is APPROVED, on a unanimous voice vote:

THE FOLLOWING INFORMAL HEARING WAS LAID ON THE TABLE AT THE MEETINGS HELD AUGUST 11 AND 25, 2010 AND IS AGAIN TAKEN UP:
CLASS BV (Victualer)
*Garrity Pub & Restaurant, Inc., d/b/a Corinne’s Banquets, 67 Garrity St. LIC#4208 (ent)
STIPULATIONS:
1. One member of management shall be on duty at all times.
2. Licensee shall immediately notify District Councilor of any changes at establishment.
3. Pawtucket residents shall be given preference for employment.
4. A detail officer shall be hired on Friday and Saturday evenings from 10:00 p.m. until 2:00 a.m. – when over 200 people are expected – a private detail may be used when less than 200 people are expected.
5. No storage trailers shall be located on the premises.
6. All doors must be kept closed at all times.
Present is Jarrod Ilkowitz, 20 Garson Lane, Attleboro, MA, Manager.
Councilor Moran reviews that things are currently running smoothly and there have not been any problems.
Mr. Ilkowitz states that they have been working well with the Police to have details on a as needed basis.
Councilor Moran states that he will keep the stipulations as currently on the license and he will review this matter again in March to see how thing are going then.

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
With majority consent of the Council, the following motion made by Councilor Wildenhain, seconded by Councilor Barry, is PASSED on a unanimous voice vote:
The Clerk is instructed to send a communication to Nova Churrasqueira Restaurant J & M LTD d/b/a Nova Churrasqueira, 434 Broadway, Pawtucket, RI, to appear at an FORMAL HEARING on Wednesday, September 22, 2010, for the following reasons:
Failure to maintain control of patrons and/or endangering the health, safety and welfare of the general public and/or permitting the place where you are licensed to sell beverages to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood and/or permitting any of the laws of this state to be violated in the neighborhood, on various dates.
Upon motion made by Councilor Barros, seconded by Councilor Wildenhain, the meeting is adjourned at 7:18 p.m.
