Pawtucket Board of License Commissioners

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 6, 2010, at 6:45 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Kinch, Councilors Barros, Barry, Chadwick, Hodge, Moran, Tetreault and Vitali.
Absent – Councilor Wildenhain.
Chairperson Kinch presides.
The reading of the records of December 9, 2009 is dispensed with and the records are approved as prepared by the Clerk. The meeting of December 16, 2009 was cancelled.
A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:
CLASS A
PLW MA Inc., d/b/a Blackstone Wine & Spirits (transfer of location from 1179 Central Avenue) 273 Newport Avenue LIC#5459
Representing the license holder is Michael Sendley, Attorney, 1168 Newport Avenue. Also present is applicant Craig Power, 94 Wendell Road, Warwick, RI.
Upon questioning from Attorney Sendley, Mr. Power says that he has had a class A liquor license at his present store since 2005.
He states that he was never brought before the licensing board for any problems. He has been in the liquor business for sixteen years.
His business currently is on Central Avenue.
He would like to transfer the business to Newport Avenue because it is a bigger store; he will be able to serve more items. The store will be 3,720 square feet. He will have four employees.
The hours will be from 9am to 10pm Monday thru Saturday and from 12 noon to 6pm on Sunday.
All employees have alcohol training.
He notes that the Newport Avenue space was a retail store.
There are no other liquor stores within 1000 feet.
Attorney Sendley discusses the 200 foot rule regarding churches. He states that it is not applicable. He submitted copies of RIGL Sec 3-7-4 and 3-7-19. He states that the 200 foot rule applies only between two liquor stores. It applies to churches only for Class B, C, and I Licenses.
Mr. Power is aware that he is next to an ice cream store. He is very diligent about carding and loitering.
There are 10-12 parking spaces in the parking lot. There will be 6-7 deliveries to the store each week between 9am to 5pm.
The dumpster will be in the back of the store.
Mr. Power spends 10-12 hours a week at the current store. He will not hire anyone under age 21.
Speaking in opposition is Mark Bennett, 46 Corrente Avenue, Pawtucket, RI.
Mr. Bennett is a manager at Perry’s Liquor Store on Columbus Avenue. He states that there are enough liquor stores in the area. Another store will hurt him badly.
Speaking in opposition is Tony Carreira, 36 Reynolds Avenue, Rehoboth, MA.
Mr. Carreira is with Beverage Hill Liquors. He is concerned about losing business to a larger store. He may end up being closed. He has been there for 15 years.
There are no other speakers.
