A regular session of the Pawtucket Board of License Commissioners is held Wednesday, February 24, 2010, at 7:31 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Kinch, Councilors Barros, Barry, Chadwick, Moran, Tetreault and Vitali.
Absent – Councilor Hodge.
Chairperson Kinch presides.
The reading of the records of February 16, 2010 is dispensed with and the records are approved as prepared by the Clerk.
THE FOLLOWING FORMAL HEARING WAS LAID ON THE TABLE AT THE MEETING HELD FEBRUARY 16, 2010, AND IS AGAIN TAKEN UP AND IS AGAIN CONTINUED UNTIL THE MEETING OF MARCH 10, 2010, ON A UNANIMOUS VOICE VOTE:

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., Assistant City Solicitor.
Attorney Milos states that the license holder was notified of the hearing change from February 10, 2010, to February, 16, 2010.
Also present is license holder Jose DeBrito, 102 Knowles Street, Pawtucket, RI
Mr. DeBrito states that he come to the hearing on February 10, 2010 and saw the notice on the door that the meeting had been changed to February 16, 2010.
He states that his business was closed on February 16, 2010, and the hearing slipped his mind. He apologizes for missing the hearing. He notified the Law Office the next day.
Councilor Barry asks about the bartender not being TIPS certified. Mr. DeBrito states that the lady who served the minor doesn’t usually work there; she was filling in for someone else.
Mr. DeBrito states that all employees are TIPS certified. Mr. DeBrito presents a letter from Frank J. Faubert, President, Server Training on Premise, indicating that seven employees at Nova Churrasqueira have completed the S.T.O.P. training program, which is made part of the record.
The Hearing is Closed.
The Council advises Mr. DeBrito on the importance of appearing before the Board when summoned for a Formal Hearing.

THE CHAIR RECOGNIZES COUNCILOR CHADWICK.
With majority consent of the Council, the following motion made by Councilor Chadwick, seconded by Councilor Barry, is PASSED on a unanimous voice vote:
The Clerk is instructed to issue a summons to Howard Rogers Post, 25 McCallum Avenue, to appear at a FORMAL HEARING on Wednesday, March 24, 2010, for the following reasons:
1. On or about November 29, 2009: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).
2. On or about December 27, 2009: Violation of the following specific condition to the grant of the license: 1. Police Detail Officer shall be required at all events.
3. On or about January 16, 2010: Violation of the following specific condition to the grant of the license: 1. Police Detail Officer shall be required at all events.
Upon motion made by Councilor Moran, seconded by Councilor Chadwick, the meeting is adjourned at 7:44 p.m.
