A regular session of the Pawtucket Board of License Commissioners is held Wednesday, February 11, 2009, at 7:10 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Kinch, Councilors Barros, Barry, Chadwick, Hodge, Moran, Tetreault, Vitali, and Wildenhain.
Absent – 0.
Chairperson Kinch presides.
The reading of the records of January 21, 2009 is dispensed with and the records are approved as prepared by the Clerk.
A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:
CLASS A
Great Entreprenurial Endeavors, Inc., d/b/a Gee’s Liquors, 347 Broadway (transfer from 400 Broadway) LIC#5065
Speaking in favor is Attorney Michael Horan, 393 Armistice Blvd, Pawtucket, RI, representing the applicant.
Mr. Horan states that the applicant is out of the country.
Speaking in opposition is Susan Monk, 29 Allen Avenue, Pawtucket, RI
Ms. Monk is concerned that moving the establishment closer to the residential part of the street will have a negative impact on the neighborhood. The business should stay where the other commercial businesses are. She is also concerned about litter.
Speaking in opposition is James Whatmough, 7 Daniels Street, Pawtucket, RI
Mr. Whatmough states that he bought his house in August. There has already been a robbery in the neighborhood. He bought the house in that neighborhood because it is a moderately priced area.
He is concerned about cars coming off the highway to go to the store. He doesn’t believe that a liquor store is what you want to have in a rebuilding neighborhood. He states that there is a transient population in the neighborhood, but now more people are buying property and living there. He is also concerned about vagrants and safety.
Speaking in opposition is Jason Kendall, 9 Daniels Street, Pawtucket, RI
Mr. Kendall states that they are battling against blight there and are doing a good job. Whatever goes in there (347 Broadway), there should be restrictions. He’s been there for five years, and has been picking up nip bottles and beer bottles every day. He is concerned that if the liquor store moves closer to residential end of street, there will be more problems.
Speaking in opposition is Earlene Hines, 12 Greene Street, Pawtucket, RI
Mr. Hines believes that Gee’s was caught in a police sting before.

Upon motion made by Councilor Barry, seconded by Councilor Hodge, the following license is Laid on the Table and the hearing is recessed until February 25, 2009, on a unanimous voice vote.

(Sale of Alcohol to underage persons – CV Lounge, 214 Broad Street; Le Noir, 852 Newport Avenue; and Peddler Inn Inc., 94 Middle Street) is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR MORAN.
With majority consent of the Council, the following motion made by Councilor Moran, seconded by Councilor Hodge, is PASSED on a unanimous voice vote:
The Clerk is instructed to issue summonses to CV Lounge, 214 Broad Street; Le Noir, 852 Newport Avenue; and Peddler Inn Inc., 94 Middle Street, to appear at FORMAL HEARINGS on Wednesday, February 25, 2009, for the following reasons:
1. On or about January 2, 2009: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).
2. On or about January 2, 2009: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).
Communication from Major Bruce Moreau, Patrol Commander, Pawtucket Police Department, to Pawtucket City Council, Board of License Commissioners. (Illegal gambling pool, selling quantities of cocaine and marijuana to patrons – Ray’s Boulevard Tap, 572 Armistice Blvd) is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
With majority consent of the Council, the following motion made by Councilor Wildenhain, seconded by Councilor Hodge, is PASSED on a unanimous voice vote:
The Clerk is instructed to issue a summons to Ray’s Boulevard Tap, 572 Armistice Boulevard, to appear at a FORMAL HEARING on Wednesday, February 25, 2009, for the following reasons:
1. Failure to maintain control of patrons and/or employees or agents; and/or endangering the health, safety and welfare of the general public; and/or permitting any gambling or unlawful gaming to be carried on in the house or place where you are licensed to sell alcoholic beverages; and/or permitting any of the laws of this state to be violated in the neighborhood, to wit, the sale of narcotics (R.I.G.L. 3-5-23 and Rule 23 of Liquor Control Administration)
Communication from Michael Naughton, President, Galway Bay, LLC d/b/a Galway Bay Irish Pub, to the Honorable Members of the Pawtucket City Council requesting permission to hold a “St. Patrick’s Day” celebration and to serve food and alcoholic beverages in the parking lot of 158 South Bend Street on Tuesday, March 17, 2009, beginning at 2:00 p.m. is READ AND ORDERED FILED and the request is APPROVED on a unanimous voice vote, with the following stipulations.
STIPULATIONS:
1. Hire a Pawtucket Police Officer for detail.
2. Use one entrance only.
3. No one may leave the area with alcohol.
4. Maximum of 100 people in patio area.
5. Tented area will have two means of egress, and will be equipped with emergency lighting as necessary.
6. Any music must cease outdoors at 10:00 p.m.
7. Outdoor activity ends at 12:00 Midnight.
Upon motion made by Councilor Hodge, seconded by Councilor Barry, the meeting is adjourned at 7:41 p.m.
