A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 8, 2009, at 7:04 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Kinch, Councilors Barros, Hodge, Moran, Tetreault, Vitali
Absent – Councilors Barry, Chadwick and Wildenhain.
Chairperson Kinch presides.
The reading of the records of March 25, 2009 is dispensed with and the records are approved as prepared by the Clerk.
A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:
CLASS B (Victualer)
R House Restaurant, Inc., d/b/a Roast House Restaurant and Pub, (transfer from My Brother’s Pub Ltd., d/b/a My Brother’s Pub) 176 Columbus Ave. LIC#5074
Representing the license holder is Jorge Diogo, 522 South Main Street, Woonsocket, RI
Upon questioning by President Kinch, Mr. Diogo states that he has restaurant experience. He has been with the Roast House for 32 years and has been general manager for 25 years.
He started at the Roast House in Lincoln, and then ran the one in East Providence until the fire a few years ago. He is currently running the Roast House in Blackstone MA.
The hours will be Sunday thru Thursday 11:00 am to 11:00 pm., and Friday thru Saturday from 11:00 am to 12:00 am and the will be open until Pub until 1:00 am.
It will be a family restaurant. The restaurant will be open by the end of the May. There will be some renovations and they will be getting the building up to code.
The next speaker is Luis Soares, 18 Chestnut Street, Pawtucket, RI
Mr. Soares asks what the layout will be and asks if the back entrance will be opened again. He states that neighbors may have concerns if the back entrance is opened.
Upon questioning by Councilor Vitali, Mr. Diogo states that generally local employees will be hired, 70% of them will be part time. There will be approximately 36 employees at this location.
Councilor Chadwick asks what kind of changes will be made.
Mr. Diogo states that the changes will be cosmetic only.

Upon motion made by Councilor Wildenhain, seconded by Councilor Hodge, the following license is APPROVED, SUBJECT TO THE PAYMENT OF ALL OUTSTANDING CLAIMS, on a unanimous voice vote:

COUNCILOR HODGE LEAVES THE CHAMBERS AT 7:16 PM
THE MATTER OF A FORMAL HEARING REGARDING THE FOLLOWING LICENSE, WHICH WAS LAID ON THE TABLE AT THE MEETINGS HELD FEBRUARY 25, MARCH 11 AND MARCH 25, 2009, IS AGAIN TAKEN UP:

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., Assistant City Solicitor.
Also present is the attorney for the license holder, Gordon D. Fox.
COUNCILOR HODGE RETURNS TO THE CHAMBERS AT 7:18 PM
Attorney Milos states that the license holder has agreed to enter a plea of nolo contender. He states that Councilor Wildenhain has agreed to accept the plea, with a $500.00 fine and no suspension.
Attorney Milos states that he must pay the $500.00 fine by the end of the business day on April 13, 2009, if not the establishment may not reopen until the fine is paid.

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
Upon motion made by Councilor Wildenhain, seconded by Councilor Barry, the City Council ACCEPTS A PLEA OF NOLO CONTENDRE AND ORDERS THAT THE LICENSE HOLDER PAY A $500.00 FINE WHICH MUST BE PAID BY THE END OF THE BUSINESS DAY ON APRIL 13, 2009, OR THE LICENSE HOLDER MAY NOT OPEN UNTIL THE FINE IS PAID, FOR THE FOLLOWING REASONS:
1. On or about January 2, 2009: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).
2. On or about January 2, 2009: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).
Communication from Paul J. Pisano, Attorney, to Pawtucket Board of License Commissioners, objecting to the transfer of Class B (Victualer) Liquor License of My Brother’s Pub Ltd., d/b/a My Brother’s Pub to R-House Restaurant Inc., d/b/a Roast House Restaurant & Pub in the total amount of $2,860.72 is READ AND ORDERED FILED.
Communication from McLaughlin & Moran, Inc., to Pawtucket Board of License Commissioners, objecting to the transfer of Class B (Victualer) Liquor License of My Brother’s Pub Ltd., d/b/a My Brother’s Pub to R-House Restaurant Inc., d/b/a Roast House Restaurant & Pub in the total amount of $368.02 is READ AND ORDERED FILED.
