Pawtucket Board of License Commissioners

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, October 22, 2008, at 6:46 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Bray, Councilors Barry, Chadwick, Hodge and Kinch.
Absent – Councilors Grebien, Moran and Wildenhain.
Chairperson Bray presides.
The reading of the records of October 8, 2008 is dispensed with and the records are approved as prepared by the Clerk.
THE MATTER OF A FORMAL HEARING REGARDING THE FOLLOWING LICENSE IS TAKEN UP:
CLASS B (Victualer)
Tropical Vibes Corporation d/b/a Tabu Restaurant & Lounge, 17 Exchange Street (transfer of 75% change in stockholders)
Representing the city of Pawtucket is Frank J. Milos, Assistant City Solicitor.
Mr. Milos states that as of today, all of the items needed to complete the transfer of the liquor license have been provided to the city clerk’s office. Therefore, the new license may be issued tomorrow.
Councilor Barry asks if the newspaper reported police activity at Tabu earlier this week.
Mr. Milos states that he does not know; however, any police action could be considered during the renewal hearing, not at this hearing. Tonight, the only matter before the Board is the punch list of items to be completed for the transfer of the license.
COUNCILOR GREBIEN ARRIVES AT 6:55 P.M.
THE CHAIR RECOGNIZES COUNCILOR CHADWICK
The motion made by Councilor Chadwick, seconded by Councilor Hodge, NOT TO RESCIND the transfer of 75% of stockholders of Tropical Vibes Corporation d/b/a Tabu Restaurant & Lounge, 17 Exchange Street is APPROVED, on a majority voice vote. Councilor Barry votes “No.”
THE MATTER OF A FORMAL HEARING REGARDING THE FOLLOWING LICENSE IS TAKEN UP:

Leprechaun Lounge Inc. d/b/a Leprechaun Lounge (transfer to Debra A. Ricci d/b/a Leprechaun Lounge) 602 Smithfield Ave.
Representing the city of Pawtucket is Frank J. Milos, Assistant City Solicitor.
Mr. Milos states that four of the punch items needed to complete the transfer of the liquor license have not yet been provided to the city clerk’s office. About $3,000 in taxes is still owed to the RI Division of Taxation. Also needed is Department of Health approval, proof of workers’ comp insurance and a copy of the lease. All of the items were supposed to be provided by last Thursday.
THE CHAIR RECOGNIZES COUNCILOR CHADWICK
Upon motion made by Councilor Chadwick, seconded by Councilor Hodge, the transfer of the CLASS B (Victualer) liquor license of Leprechaun Lounge Inc. d/b/a Leprechaun Lounge to Debra A. Ricci d/b/a Leprechaun Lounge, 602 Smithfield Ave. IS RESCINDED AS OF 12:00 P.M. ON OCTOBER 29, 2008, UNLESS ALL OF THE ITEMS NEEDED TO COMPLETE THE TRANSFER OF THE LIQUOR LICENSE HAVE BEEN PROVIDED TO THE CITY CLERK’S OFFICE BY THAT TIME, on a unanimous voice vote.
THE CHAIR RECOGNIZES COUNCILOR HODGE.
With majority consent of the Council, the following motion made by Councilor Hodge, seconded by Councilor Barry, is PASSED on a unanimous voice vote:
The Clerk is instructed to send a communication to all Liquor License Holders to ask if their establishments are being run by the license holders or by others under a management contract. If they are being run under management contracts, the Board wants to know who are running the establishments. As part of the liquor license renewal process, which is scheduled for November 5, 2008, the City Council is requiring the answer by Thursday, October 30, 2008.
Upon motion made by Councilor Hodge, seconded by Councilor Barry, the meeting is adjourned at 7:20 p.m.
