A regular session of the Pawtucket Board of License Commissioners is held Wednesday, March 5, 2008, at 6:58 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Bray, Councilors Barry, Chadwick, Hodge, Kinch and Moran.
Absent – Councilors Carr, Grebien and Wildenhain.
Chairperson Bray presides.
The reading of the records of February 20, 2008 is dispensed with and the records are approved as prepared by the Clerk.
THE MATTER OF A FORMAL HEARING REGARDING THE FOLLOWING LICENSE IS TAKNE UP:
CLASS A
Great Entrepreneurial Endeavors Inc., d/b/a Gee’s Liquors, 400 Broadway, LIC#4301
Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., Assistant City Solicitor.
Representing the license holder is John Anthony Santos, President of Gee’s Liquors.
Also present at the hearing is Stenographer Sandra Bachini Gaboriault.

THE CHAIR RECOGNIZES COUNCILOR MORAN.
Upon motion made by Councilor Moran, seconded by Councilor Hodge, the plea of NOLO CONTENDRE by Great Entrepreneurial Endeavors Inc., d/b/a Gee’s Liquors, 400 Broadway, is APPROVED by the Board of License Commissioners on a unanimous voice vote. The license holder shall PAY A $500.00 FINE AND THE LICENSE SHALL BE SUSPENDED FOR A PERIOD OF FOUR (4) DAYS, SPECIFICALLY SUNDAY, MARCH 9, 2008; MONDAY, MARCH 10, 2008; TUESDAY, MARCH 11, 2008; AND WEDNESDAY, MARCH 12, 2008, FOR THE FOLLOWING REASONS:
1. On or about January 15, 2008: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).
2. On or about January 15, 2008: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).

THE CHAIR RECOGNIZES COUNCILOR HODGE.
With majority consent of the Council, the following motion made by Councilor Hodge, seconded by Councilor Chadwick, is PASSED on a unanimous voice vote:
Per Order of the Department of Business Regulation, because of Federal and State court decisions rendered subsequent to the original transfer hearing on September 7, 2005, the Clerk is instructed to schedule a Public Hearing on the transfer from Gary's Liquors to PLW-MA, Inc. d/b/a Blackstone Wine & Spirits to consider (1) whether the transfer should be granted and, if so, whether Blackstone must abide by certain conditions to maintain compliance with R.I. Gen. Laws § 3-5-11 and (2) whether Blackstone’s operations violate R.I. Gen. Laws § 3-5-11 and, if so, what is the appropriate penalty.
Communication from Michael Naughton, President, Galway Bay, LLC d/b/a Galway Bay Irish Pub, to the Honorable Members of the Pawtucket City Council requesting permission to hold a “St. Patrick’s Day” celebration and to serve food and alcoholic beverages in the parking lot of 156-158 South Bend Street on Monday, March 17, 2008, beginning at 2:00 p.m. is APPROVED on a unanimous voice vote, with the following stipulations:
STIPULATIONS:
1. Hire a Pawtucket Police Officer for detail.
2. Use one entrance only.
3. No one may leave the area with alcohol.
4. Maximum of 100 people in patio area.
5. Tented area will have two means of egress, and will be equipped with emergency lighting as necessary.
6. Outdoor activity ends at 12:00 Midnight.
7. No Outside music.
COUNCILOR CARR ARRIVES AT 7:12 PM.
Communication from Thomas Brennan, Celtic Pub, 755 Broadway, to the Honorable City Council, requesting permission to serve alcoholic beverages from a tent in the parking lot on Monday, March 17, 2008, from 3:00 p.m. until 12:00 a.m. is READ AND ORDERED FILED and the request to serve alcoholic beverages from a tent in the parking lot is APPROVED on a unanimous voice vote, with the following stipulations.
1. Detail officer shall be on duty until a half hour after closing.
2. No bottles in outside lot.
3. Area must be cleaned up by next morning.

With majority consent of the Council, Councilor Barry introduces the following police report:

With majority consent of the Council, the following motion made by Councilor Barry, seconded by Councilor Hodge, is PASSED on a unanimous voice vote:
The Clerk is instructed to send a communication to Rosa’s Sunshine Lounge, LTD d/b/a Sunshine Lounge, 110 School Street, instructing the license holder to appear at an INFORMAL HEARING on Wednesday, March 19, 2008, for the following reason:
1. Operating after hours (Rule #24 – Liquor Control Administration)
