February 6, 2008

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, February 6, 2008, at 6:50 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairperson Bray, Councilors Barry, Chadwick, Grebien, Hodge, Moran and Wildenhain.

 

Absent – Councilors Carr and Kinch.

 

Chairperson Bray presides.

 

The reading of the records of January 23, 2008 is dispensed with and the records are approved as prepared by the Clerk.

 

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.

 

With majority consent of the Council, Councilor Wildenhain introduces the following communication:

 

Communication from McLaughlin & Moran, Inc., objecting to the transfer of Class B (Victualer) liquor license of Mombelly Corp d/b/a Heritage Tap, 264 Grand Avenue to Shaydan, Inc., d/b/a Heritage Tap, in the amount of $165.00

 

Upon motion made by Councilor Wildenhain, seconded by Councilor Moran, the following communication is READ AND ORDERED FIELD.

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:

 

CLASS B (Victualer)

 

Shaydan, Inc., d/b/a Heritage Tap (transfer from Mombelly Corp d/b/a Heritage Tap) 264 Grand Avenue, LIC#4878

 

PREVIOUS STIPULATION

 

1.   May seat customers outside with 3 tables on sidewalk and 4 tables on lawn.

 

Representing the license holder is Friedrika Robinson, 227 Suffolk Avenue, Pawtucket, RI, applicant.

 

Ms. Robinson states that she lives a few blocks away from the restaurant.

 

She will expand the hours to serve lunch from Tuesdays thru Saturdays.  The prior owner served lunch on Fridays only.  The restaurant will be closed on Sundays and Mondays.

 

There are no other speakers.

 

The hearing is closed.

 

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.

 

Upon motion made by Councilor Wildenhain, seconded by Councilor Moran, the following license is APPROVED, SUBJECT TO THE PAYMENT OF ALL OUTSTANDING CLAIMS, on a unanimous voice vote:

STIPULATION

 

1.   May seat customers outside with 3 tables on sidewalk and 4 tables on lawn.

 

Nolo plea of Blackstone At Hope LLC d/b/a Blackstone, 1005 Main Street, for violations of state and local liquor laws on December 12, 2007, is taken up:

 

THE CHAIR RECOGNIZES COUNCILOR HODGE.                      

 

Upon motion made by Councilor Hodge, seconded by Councilors Wildenhain and Barry, the plea of NOLO CONTENDRE, which was accepted by Blackstone At Hope LLC d/b/a Blackstone, 1005 Main Street, without a formal hearing, is APPROVED by the Board of License Commissioners on a unanimous voice vote.  The license holder shall PAY A $250.00 FINE, FOR THE FOLLOWING REASONS:

 

1.   On or about December 12, 2007: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws  § 3-8-1).

2.   On or about December 12, 2007: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Laws § 3-5-23).

 

Upon motion made by Councilor Hodge, seconded by Councilor Barry, the meeting is adjourned at 7:00 p.m.
