A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 23, 2008, at 7:05 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairperson Bray, Councilors Barry, Chadwick, Grebien, Hodge, Kinch, Moran and Wildenhain.
Absent – Councilors Carr.
Chairperson Bray presides.
The reading of the records of April 9, 2008 is dispensed with and the records are approved as prepared by the Clerk.
Communication from Paul J. Pisano, Attorney, to Pawtucket Board of License Commissioners, objecting to the transfer of Class A Liquor License of Dexter Warehouse Liquors Inc., to Rod & Santi Inc., d/b/a Dexter Warehouse, in the total amount of $44,460.66 is READ AND ORDERED FILED.
Communication from Paul J. Pisano, Attorney, to Pawtucket Board of License Commissioners, objecting to the transfer of Class A Liquor License of Dexter Warehouse Liquors Inc., to Rod & Santi Inc., d/b/a Dexter Warehouse, in the total amount of $4,111.68 is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR HODGE.
With majority consent of the Council, Councilor Hodge introduces the following communication:
Communication from McLaughlin & Moran, Inc., to Pawtucket Board of License Commissioners, objecting to the transfer of Class A liquor license of Dexter Warehouse Liquors Inc., 265 Barton Street, in the amount of $12,764.63
Upon motion made by Councilor Hodge, seconded by Councilor Chadwick, the following communication is READ AND ORDERED FIELD.

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:

Representing the license holder is Hector Lopez, 605 Hodges Street, Taunton, MA, applicant
Mr. Lopez states that the hours will be Monday thru Saturday from 7:00 am to 11:00 pm, Sunday from 12:00 Noon to 6:00 pm

Mr. Lopez states that the only employees will be he and his wife.
He also states that he had a similar business in another country.
The business will be his family’s livelihood. He takes his responsibilities seriously.
There are no other speakers.
The hearing is closed.

Upon motion made by Chadwick, seconded by Councilors Barry and Hodge, the following license is APPROVED, SUBJECT TO THE PAYMENT OF ALL OUTSTANDING CLAIMS, on a unanimous voice vote:

Upon motion made by Councilor Barry, seconded by Councilor Wildenhain, Alves Productions Inc., d/b/a Tropical Liquors, 280 East Avenue, is FINED $750.00 AND THE LICENSE SHALL BE SUSPENDED FOR A PERIOD OF SEVEN (7) DAYS, BEGINNING ON SUNDAY, MAY 4, 2008, UP TO AND INCLUDING SATURDAY, MAY 10, 2008, FOR THE FOLLOWING REASONS:
1. On or about March 21, 2008: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).
2. On or about March 21, 2008: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).
