A regular session of the Pawtucket Board of License Commissioners is held Wednesday, November 7, 2007, at 6:56 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Councilors Bray, Barry, Chadwick, Grebien, Hodge, Kinch, Moran and Wildenhain.

 

Absent – Councilor Carr.

 

Councilor Bray presides.

 

The reading of the records of October 24, 2007 is dispensed with and the records are approved as prepared by the Clerk.

1.   On or about October 6, 2007:  Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).

Upon motion made by Councilor Wildenhain, seconded by Councilors Barry and Chadwick, THE LICENSE OF EAGLE EXPRESS CHINESE RESTAURANT CORPORATION D/B/A LE-NOIR BAR, IS HEREBY SUSPENDED UNTIL THE FINE OF $500.00 IS PAID OR THE LICENSE EXPIRES ON DECEMBER 1, 2007, WHICHEVER COMES FIRST, FOR THE FOLLOWING REASON:

 

1.   Failure to pay the $500.00 fine imposed on October 10, 2007 after a formal hearing where Eagle Express Chinese Restaurant Corporation was found to be in violation of state law, city ordinances and liquor control administration rules to the specific charges of (1) Operating after hours on or about August 27, 2007 (Violation of R.I. Gen. Laws § 3-7-7, Pawtucket Ordinance § 108-18 and Rule 18 of Liquor Control Administration) and (2) failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).

 

As the renewal of this liquor license will be before the Board again on November 20, 2007, failure to pay this fine prior to November 20, 2007, may result in further action by the Board of License Commissioners, including action on the renewal of your license.

Councilor Chadwick requests that representatives of Tropical Vibes Corporation, the owner of Tabu Restaurant & Lounge, approach the podium to answer questions about the current ownership of the Corporation.

 

Representing the majority owner of the corporation, Marques Smith, is Attorney William Delaney, 55 Dorrance Street, Providence, RI

 

Representing the minority owner of the corporation, Maria Alzate, is her son, Louis Alzate.

 

Representing the city is Frank J. Milos, Jr., Esq., Assistant City Solicitor.

 

Mr. Delaney states that Mr. Smith owns 75% of the stock and Ms. Alzate owns 25% of the stock, which has not been issued.

 

He states that the matter was in court today and the judge temporarily enjoined any sale of the corporation.

 

He requests that the license be suspended until this matter is decided.

 

Mr. Alzate does not want the business closed.

 

Upon questioning from the Council, Mr. Alzate states that they (he and his mother) are running the restaurant.

 

The Council expresses their concerns about allowing the business to run when the majority owner requests that it be closed.

THE CHAIR RECOGNIZES COUNCILOR CHADWICK.

 

Upon motion made by Councilor Chadwick, seconded by Councilor Barry, Tropical Vibes Corporation d/b/a Tabu Restaurant & Lounge, 17 Exchange Street is Ordered by the Pawtucket City Council, acting in its capacity as the Pawtucket Board of License Commissioners: (1) the renewal application for the Class B liquor license of Tropical Vibes Corporation d/b/a Tabu Restaurant and Lounge (License # 4199) is hereby tabled, and (2) the Class B liquor license of Tropical Vibes Corporation d/b/a Tabu Restaurant and Lounge (License # 4199) is hereby suspended indefinitely for the following reasons:

 

1.      The Board of License Commissioners is not in possession of documentation or other evidence which shows that Maria Alzate has the authority to file an application for the renewal of the Class B liquor license of Tropical Vibes Corporation d/b/a Tabu Restaurant and Lounge;

 

2.      The Board of License Commissioners, in light of the representations made by Attorney William Delaney, is concerned that the purported minority shareholder, Maria Alzate, and/or her agents, may attempt to continue to operate the business of Tabu Restaurant and Lounge and to dispense alcoholic beverages without the actual authority of the Corporation.

 

3.      The Board of License Commissioners, in light of the representations made by Attorney William Delaney, is concerned that the unauthorized dispensing of alcoholic beverages by Tabu Restaurant and Lounge, Maria Alzate, and/or her agents, could endanger the health, safety and welfare of the general public, and that said unauthorized actions could also result in liability on the part of the City of Pawtucket for knowingly allowing the alcoholic beverages to be dispensed.

 

THE CHAIR RECOGNIZES COUNCILOR HODGE.

 

Upon motion made by Councilor Hodge, seconded by Councilors Chadwick and Barry, the following is APPROVED on a unanimous voice vote:

 

In conformity with Section 3-8-1 of the General laws of the State of Rhode Island, Class C liquor establishments are hereby entitled to be open on New Year’s Day, January 1, 2008.

 

THE CHAIR RECOGNIZES COUNCILOR HODGE.

 

Upon motion made by Councilor Hodge, seconded by Councilor Chadwick, the following is APPROVED on a unanimous voice vote:

 

In conformity with Chapter 242 of the Public Laws of Rhode Island, 1962, Class B liquor establishments are hereby entitled to remain open on New Year’s morning, January 1, 2008, until 3:00 a.m.  Alcoholic beverages CANNOT be sold after the usual closing hour of 1:00 a.m.

 

Upon motion made by Councilor Hodge, seconded by Councilor Chadwick, the meeting is adjourned at 7:46 p.m.
