March 21, 2007

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, March 21, 2007, at 7:10 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Councilors Bray, Barry, Carr, Chadwick, Grebien, Hodge, Kinch, Moran, and Wildenhain.

 

Absent – 0.

 

Councilor Bray presides.

 

The reading of the records of March 7, 2007 is dispensed with and the records are approved as prepared by the Clerk.

 

THE CHAIR RECOGNIZES COUNCILOR BARRY.

 

With majority consent of the Council, Councilor Barry introduces the following communication:

 

Communication from Marc Dupuis, Vice President of Dupuis Oil, to the Pawtucket Board of License Commissioners. (Agreement with DIP Inc., on claim)

 

Upon motion made by Councilor Barry, seconded by Councilor Hodge, the following communication is READ AND ORDERED FILED.

THE CHAIR RECOGNIZES COUNCILOR BARRY.

 

With majority consent of the Council, Councilor Barry introduces the following agreement:

 

Agreement between DIP Inc., and creditors Scott Sogard, Paramount Hospitality Group, LLC and David L. Miller.

 

Upon motion made by Councilor Barry, seconded by Councilor Hodge, the following agreement is READ AND ORDERED FILED.

THE FOLLOWING APPLICATION WAS LAID ON THE TABLE AT THE MEETINGS HELD FEBRUARY 7 & 21 & MARCH 7, 2007, AND IS AGAIN TAKEN UP:

 

CLASS B (Victualer)

 

DIP Inc., d/b/a Doherty’s East Ave Irish Pub, (Transfer from Tory’s Tavern LLC d/b/a East Avenue Café) 342 East Ave. LIC#10368

 

Speaking in favor of the transfer is attorney Joseph Raheb, 650 Washington Highway, Lincoln, RI, representing Tory’s Tavern, LLC.

 

Mr. Raheb states that they have reached agreements with Dupuis Oil Co.; Scott Sogard, Paramount Hospitality Group, LLC and David L. Miller on their claims.

 

Speaking is David Miller, 28 Burchland Avenue, Pawtucket, RI

 

He states that evidence and facts outweigh rumors.

 

Mr. Miller states that Jack Doherty is the one who negotiated the agreement, not the license holder.

 

Councilor Barry asks Mr. Raheb what they offered Mr. Dupuis.

 

Councilor Barry states that Mr. Dupuis told him that he was told by Mr. Raheb to take 70% on his claim or face the possibility of the license holder declaring bankruptcy. Mr. Raheb denies saying that.

 

There are no other speakers.

 

The Hearing is closed.

 

THE CHAIR RECOGNIZES COUNCIL BARRY.

 

Upon motion made by Councilor Barry, seconded by Councilors Hodge and Wildenhain, the following license is APPROVED PENDING THE SETTLEMENT OF ALL OUTSTANDING CLAIMS, on a unanimous voice vote. Prior to the issuance of this license, Dupuis Oil Co.; Scott Sogard, Paramount Hospitality Group, LLC and David L. Miller must contact the City Clerk’s Office to advise that the settlements have been completed.

Upon motion made by Councilor Hodge, seconded by Councilor Barry, the meeting is adjourned at 7:21 p.m.
