A regular session of the Pawtucket Board of License Commissioners is held Wednesday, June 20, 2007, at 6:48 p.m. in the Municipal Court Room, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Councilors Chadwick, Grebien, Hodge, Kinch, Moran, and Wildenhain.
Absent – President Bray, Councilors Barry, Carr.
President Pro-tempore Hodge presides.
The reading of the records of June 6, 2007 is dispensed with and the records are approved as prepared by the Clerk.
Communication from Joseph A. Boccelli, President of the Alden Street Food Services LLC d/b/a Volcano Grill, 47 Mendon Avenue, to Pawtucket Board of License Commissioners, requesting permission to sell alcoholic beverages, grilled food and to have entertainment in the parking lot, 47 Mendon Avenue, on Monday, July 2, and Tuesday, July 3, 2007, from 5:00 p.m. to 10:00 p.m. is READ AND ORDERED FILED AND THE REQUEST IS APPROVED WITH THE FOLLOWING STIPULATION TO REMAIN IN PLACE, on a unanimous voice vote.
STIPULATION:
1. Paper cups only.
Communication from Mei King Restaurant, 211 South Bend Street requesting permission to sell food and soda from the parking lot of 211 South Bend on Sunday July 3, 2007, from 7:00 p.m. – 10:00 p.m. is READ AND ORDERED FILED AND THE REQUEST IS APPROVED UPON APPROVAL BY THE DISTRICT COUNCILOR.
Communication from Major Arthur J. Martins, to Councilor David Moran. (Club Macondo – 60 day report) is READ AND ORDERED FIELD.
THE CHAIR RECOGNIZES COUNCILOR MORAN.
With majority consent of the Council, the following motion made by Councilor Moran, seconded by Councilor Grebien, is PASSED on a unanimous voice vote:
The Clerk is instructed to issue a summons to Club Macondo, 241 Middle Street, Pawtucket, RI, to appear at a FORMAL HEARING on July 11, 2007, for the following reasons:
1. On or about April 9, 2007: Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state to be violated in the neighborhood (see attached police report) (Violation of R.I. Gen. Laws § 3-5-23).
2. On or about April 23, 2007: Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state to be violated in the neighborhood (see attached police report) (Violation of R.I. Gen. Laws § 3-5-23).
3. On or about May 14, 2007: Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state to be violated in the neighborhood (see attached police report) (Violation of R.I. Gen. Laws § 3-5-23).
Communication from Major Arthur J. Martins, to Richard J. Goldstein, City Clerk. (Illegal Sale of Alcohol to Underage Person) is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
With majority consent of the Council, the following motion made by Councilor Wildenhain, seconded by Councilor Carr, is PASSED on a unanimous voice vote:
The Clerk is instructed to issue summonses to Guil Viveiros, LLC d/b/a Four G’S Liquors, 462 Central Avenue and Aurora Enterprises LLC d/b/a JR Sav-On Liquors, 350 Benefit Street, Pawtucket, RI, to appear at FORMAL HEARINGS on July 11, 2007, for the following reasons:
1. On or about June 2, 2007: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).
2. On or about June 2, 2007: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).
