A regular session of the Pawtucket Board of License Commissioners is held Wednesday, June 6, 2007, at 7:07 p.m. in the Municipal Court Room, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Councilors Bray, Barry, Chadwick, Grebien, Hodge, Kinch, Moran, and Wildenhain.
Absent – Councilor Carr.
Councilor Bray presides.
The reading of the records of May 23, 2007 is dispensed with and the records are approved as prepared by the Clerk.
Communication from Ronald R. Warr, Jr., Attorney, to Pawtucket Board of License Commissioners. (Withdrawal of transfer of application of DMDD, LLC d/b/a Deluca’s Wine & Liquors, 462 Central Avenue) is READ AND ORDERED FILED.
THE FOLLOWING APPLICATION WAS LAID ON THE TABLE AT THE MEETINGS HELD APRIL 11 AND 25, 2007, AND IS AGAIN TAKEN UP AND IS TAKEN UNDER ADVISEMENT ON A UNANIMOUS VOICE VOTE.

Communication from Paul J. Pisano, Attorney, to Pawtucket Board of License Commissioners, objecting to the transfer of Class B (Victualer) Liquor License of Latin Sports Inc., d/b/a Discoteca 2000, 327 Barton Street, to Alves Productions, Inc., d/b/a Discoteca 2000, in the total amount of $1,480.87
Upon motion made by Councilor Hodge, seconded by Councilor Barry, the following communication is READ AND ORDERED FILED.

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:

Speaking in favor of the transfer is Attorney Mark Krieger, 132 Old River Road, Lincoln, RI, representing the license holder, Latin Sports Inc.
Also speaking in favor is Attorney Richard Nicholson, 931 Jefferson Boulevard, Warwick, RI. representing the applicant, Alves Productions Inc.
Mr. Krierger states that the claim will be paid at the time of the closing.
Mr. Nicholson states that the applicant owned Tropical Liquors in Pawtucket, and liquor stores and clubs in the Boston area.
Speaking in favor is applicant Filipe Andrade, 151 Rocco Avenue, Pawtucket, RI.
Mr. Andrade states that he has been in the liquor business for 11 years. He owned a night club in Roxbury, which was the same type of business as Discoteca 2000.
Mr. Andrade states that there will be no changes in operation, he will keep the same employees, and food will be served.
He states that he will be working on Wednesdays thru Sundays, from 7:00 p.m. to 1:00 a.m.
Mr. Nicholson states that there will be police officers on duty on Fridays and Saturdays from 7:00 p.m. to 1:00 a.m.
There are no other speakers.

Mr. Tevlin states that he has no experience in this type of business. This is the first time he will open an Irish Pub.
Mr. Tevin states that the capacity is 51 people. He will have 1 or 2 man bands and guitar players for entertainment.
Mr. Naughton states that he also has no experience.

Upon motion made by Councilor Kinch, seconded by Councilor Barry, the following license is APPROVED, SUBJECT TO THE PAYMENT OF ALL OUTSTANDING CLAIMS, on a unanimous voice vote:
Communication from Michael Naughton, President, Galway Bay, LLC d/b/a Galway Bay Irish Pub, to the Honorable Members of the Pawtucket City Council requesting permission to serve food and alcoholic beverages in the parking lot of 156-158 South Bend Street on Tuesday, July 3, 2007, beginning at 4:00 p.m. is READ AND ORDERED FILED AND THE REQUEST IS APPROVED WITH THE FOLLOWING STIPULATIONS TO REMAIN IN PLACE, on a unanimous voice vote.
STIPULATIONS:
Entire area is temporarily fenced in.
Hire a Pawtucket Police Officer for crowd control.
Use one entrance only.
No one may leave the area with alcohol.

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
Upon motion made by Councilor Wildenhain, seconded by Councilor Hodge, the license holder HAS ACCEPTED A PLEA OF NOLO CONTENDRE, AND SHALL PAY A $500.00 FINE AND THE LICENSE SHALL BE SUSPENDED FOR A PERIOD OF TWO (2) DAYS, SPECIFICALLY FRIDAY, JUNE 15, 2007 AND SATURDAY, JUNE 16, 2007, FOR THE FOLLOWING REASONS:
1. On or about March 23, 2007: Authorizing the sale or delivery to an underaged person for purposes of sale, possession or consumption of an alcoholic beverage on the license premises either for said underaged person’s own use or of any other person (Violation of R.I. Gen. Laws § 3-8-1).
2. On or about March 23, 2007: Failure to maintain control of patrons, agents or employees and/or permitting any of the laws of this state to be violated on the license premises (Violation of R.I. Gen. Laws § 3-5-23).
