A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 24, 2007, at 6:46 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Councilors Bray, Barry, Carr, Grebien, Hodge, Kinch, Moran, and Wildenhain.
Absent – 0.
Councilor Bray presides.
The reading of the records of January 10, 2007 is dispensed with and the records are approved as prepared by the Clerk.
THE ELECTION OF THE CHAIRPERSON OF THE PAWTUCKET BOARD OF LICENSE COMMISSIONERS IS TAKEN UP:
THE CHAIR RECOGNIZES COUNCILOR HODGE.
Upon motion made by Councilor Hodge, seconded by Councilor Kinch, the name of Mary E. Bray is placed in nomination for the Chairperson of the Pawtucket Board of License Commissioners.
THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
Upon motion made by Councilor Wildenhain, seconded by Councilor Grebien, the nominations are closed.
Mary E. Bray is ELECTED Chairperson of the Pawtucket Board of License Commissioners on a roll call vote, as follows:
AYES - Councilors Bray, Barry, Carr, Grebien, Hodge, Kinch, Moran, and Wildenhain.
NOES - 0.
THE ELECTION OF THE VICE-CHAIRPERSON OF THE PAWTUCKET BOARD OF LICENSE COMMISSIONERS IS TAKEN UP:
THE CHAIR RECOGNIZES COUNCILOR BARRY.
Upon motion made by Councilor Barry, seconded by Councilor Wildenhain, the name of Thomas E. Hodge is placed in nomination for the Vice-Chairperson of the Pawtucket Board of License Commissioners.
THE CHAIR RECOGNIZES COUNCILOR GREBIEN.
Upon motion made by Councilor Grebien, seconded by Councilor Wildenhain, the nominations are closed.
Thomas E. Hodge is ELECTED Vice-Chairperson of the Pawtucket Board of License Commissioners on a roll call vote, as follows:
AYES - Chairman Bray, Councilors Barry, Carr, Grebien, Hodge, Kinch, Moran, and Wildenhain.

Upon motion made by Councilor Moran, seconded by Councilors Grebien and Wildenhain, the FORMAL HEARING IS LAID ON THE TABLE AND RESCHEDULED for Wednesdays, February 7, 2007, at 6:45 p.m. at the request of the applicant, on a unanimous voice vote.
Communication from Major Arthur J. Martins to Board of License Commissioners. (Theatre Tap, 607 Smithfield Avenue) is READ AND ORDERED FIELD.

With majority consent of the Council, the following motion made by Councilor Chadwick, seconded by Councilor Barry, is PASSED on a unanimous voice vote:
The Clerk is instructed to issue a summons to Aladdin Club Inc., d/b/a Theatre Tap, 607 Smithfield Avenue, Pawtucket, RI, to appear at a FORMAL HEARING on Wednesday, February 7, 2007, for the following reason:
Failure to maintain control of patrons and/or employees, agents, endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state or ordinances of the city to be violated in the neighborhood.
Consumption of alcoholic beverages outside of the licensed premises, in violation of RIGL 3-5-9 entitled “Premises Covered”, rule #27 of the RI Department of Business Administration Handbook “Commercial Licensing Regulation 8 Liquor Control Administration” and § 108-14 of Pawtucket Code of Ordinances, which prohibits alcoholic beverages from being consumed on City streets and sidewalks.
Communication from George J. Sukatos, Attorney, to Pawtucket Board of License Commissioners. (Elias Dernikos d/b/a City Line Pizza & Restaurant, 594 Pawtucket Avenue – closing the establishment on Saturdays) is READ AND ORDERED FILED.
Communication from Rob Yaffe, President of Lionheart Marketing Corp., d/b/a Garden Grill, 727 East Avenue, to Council President Mary E. Bray. (Removing a stipulation “No Entertainment”). IS READ AND ORDERED FILED AND THE REQUEST TO REMOVE THE STIPULATION IS APPROVED ON A UNANIMOUS VOICE VOTE.
