A regular session of the Pawtucket Board of License Commissioners is held Wednesday, February 21, 2007, at 6:50 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairman Bray; Councilors Barry, Chadwick, Hodge, Kinch, Moran, and Wildenhain.
Absent – Councilors Carr and Grebien.
Chairman Bray presides.
The reading of the records of February 7, 2007, is dispensed with and the records are approved as prepared by the Clerk.
Communication from Margaret M. Lynch-Gadaleta, Esq., City Solicitor, to Jeffrey J. Greer, Associate Director Department of Business Regulation. (East Avenue Café) is READ AND ORDERED FILED.

Upon motion made by Councilor Chadwick, seconded by Councilors Barry and Hodge, the License holder HAS ACCEPTED A PLEA OF NOLO CONTENDRE AND SHALL PAY A $150.00 FINE, FOR THE FOLLOWING REASONS:
1. Failure to maintain control of patrons and/or employees, agents, endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state or ordinances of the city to be violated in the neighborhood, on or about January 4, 2007.
2. Consumption of alcoholic beverages outside of the licensed premises, in violation of RIGL 3-5-9 entitled “Premises Covered”, rule #27 of the RI Department of Business Administration Handbook “Commercial Licensing Regulation 8 Liquor Control Administration” and § 108-14 of Pawtucket Code of Ordinances, which prohibits alcoholic beverages from being consumed on City streets and sidewalks, on or about January 4, 2007.

Upon motion made by Councilor Hodge, seconded by Councilor Chadwick, the following communication is READ AND ORDERED FILED:
Communication from Yu Cheng Zou, President of Eagle Express Chinese Restaurant Corporation d/b/a Cutie Pie, to Pawtucket Board of License Commissioners. (Requesting to change d/b/a name from Cutie Pie to Le-Noir)
Present to discuss the request for the name change are license holder Yu Cheng Zou, 3 Kirker Drive, East Greenwich, RI and manager Jennifer Rodiguez, 2305 Diamond Hill Road, Woonsocket, RI,
Councilor Wildenhain wants the license holder to avoid the problems of the past; specifically, with closing hours, parking and beer bottles in the private lot across the street and making sure that they have a menu and food service.
Upon motion made by Councilor Wildenhain, seconded by Councilors Hodge and Barry, the request for a name change of Eagle Express Chinese Restaurant Corporation d/b/a Cutie Pie to Eagle Express Chinese Restaurant Corporation d/b/a Le-Noir is APPROVED.
