A regular session of the Pawtucket Board of License Commissioners is held Wednesday, August 8, 2007, at 6:47 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Councilors Bray, Barry, Carr, Chadwick, Grebien, Hodge, Kinch and Wildenhain.

 

Absent – Councilor Moran.

 

Councilor Bray presides.

 

The reading of the records of July 25, 2007 is dispensed with and the records are approved as prepared by the Clerk.

 

THE MATTER OF A FORMAL HEARING REGARDING THE FOLLOWING LICENSE IS TAKEN UP:

           

CLASS B (Victualer)

 

Teodoro & Benvindo Depina d/b/a E. A. Tavern, 4 Grace St. LIC#10282

 

Representing the City of Pawtucket is  Margaret M. Lynch-Gadaleta, Esq., City Solicitor.

 

Also present at the hearing are license holder Benvindo Depina and stenographer Sandra Bachini Gaboriault.

 

THE DETAIL TESTIMONY IS FILED IN THE VAULT OF THE CITY CLERK’S OFFICE.

 

THE CHAIR RECOGNIZES COUNCILOR BARRY.

 

Upon motion made by Councilor Barry, seconded by Councilors Hodge and Chadwick, the  FOLLOWING STIPULATION IS ADDED TO THE CLASS B (VICTUALER) LIQUOR LICENSE OF TEODORO AND BENVINDO DEPINA D/B/A E&A TAVERN, 4 GRACE ST, LICE#10282, AS FOLLOWS:

 

STIPULATION:  NO DISC JOCKEYS (DJ) OR ENTERTAINMENT ALLOWED.

 

THIS STIPULATION HAS BEEN ADDED FOR THE FOLLOWING REASONS:

 

1.  On or about December 17, 2004:  Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state to be violated in the neighborhood (see attached police report) (Violation of R.I. Gen. Laws § 3-5-23).

 

2.  On or about March 31, 2007:  Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state to be violated in the neighborhood (see attached police report) (Violation of R.I. Gen. Laws § 3-5-23).

 

3.  On or about June 17, 2007:  Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state to be violated in the neighborhood (see attached police report) (Violation of R.I. Gen. Laws § 3-5-23).

 

COUNCILOR BARRY NOTES THAT IF THERE ARE ANY PROBLEMS AT THIS ESTABLISHMENT IN THE FUTURE, HE WILL REQUIRE THE LICENSE HOLDER TO HAVE A DETAIL OFFICER ON FRIDAY AND SATURDAY NIGHTS.

 

Communication from Michael Naughton, President, Galway Bay, LLC d/b/a Galway Bay Irish Pub, to the Honorable Members of the Pawtucket City Council requesting permission to hold a “grand opening” and to serve food and alcoholic beverages in the parking lot of 156-158 South Bend Street on Saturday, August 11, 2007, beginning at 4:00 p.m. is READ AND ORDERED FILED AND THE REQUEST IS APPROVED WITH THE FOLLOWING STIPULATIONS, on a unanimous voice vote.

 

STIPULATIONS:

 

Entire area is temporarily fenced in.

Hire a Pawtucket Police Officer for crowd control.

Use one entrance only.

No one may leave the area with alcohol.

Maximum of 100 people in patio area.

 

Upon motion made by Councilor Hodge, seconded by Councilor Barry, the meeting is adjourned at 6:58 p.m.
