A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 11, 2007, at 6:47 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Councilors Bray, Barry, Chadwick, Grebien, Hodge, Kinch, Moran, and Wildenhain.
Absent – Councilor Carr.
Councilor Bray presides.
The reading of the records of March 21, 2007 is dispensed with and the records are approved as prepared by the Clerk.
Communication from Paul J. Pisano, Attorney, to Pawtucket Board of License Commissioners, objecting to the transfer of Class A liquor license of Guil Viveiros, LLC d/b/a Four G’s Liquors, 462 Central Avenue to DMDD LLC d/b/a Deluca’s Wine & Liquors, in the amount of $13,718.14 is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR HODGE.
With majority consent of the Council, Councilor Hodge introduces the following Communication:
Communication from Joseph A. Lamagna, Attorney, representing Hermano Gaipo, to the Pawtucket Board of License Commissioners, objecting to the transfer of Class A liquor license of Guil Viveiros, LLC d/b/a Four G’s Liquors, 462 Central Avenue to DMDD LLC d/b/a Deluca’s Wine & Liquors, in the amount of $174,894.34.
Upon motion made by Councilor Hodge, seconded by Councilor Grebien, the following communication is READ AND ORDERED FILED.

A PUBLIC HEARING ON THE FOLLOWING APPLICATION FOR LICENSE, WHICH WAS ADVERTISED FOR A HEARING AT THIS TIME, IS TAKEN UP:

DMDD, LLC d/b/a Deluca’s Wine & Liquors, (Transfer from Guil Viveiros, LLC d/b/a Four G’s Liquors) 462 Central Avenue, LIC#10370
Speaking in favor is Attorney for the applicant Ronald R. Warr, Jr., 275 Reservoir Avenue, Providence, RI 02907
Mr. Warr states that he was not aware of the Gaipo claim until a couple of hours ago. The claim was from the previous owner of the establishment. He would like an opportunity to look into the claim.
Speaking in opposition is Joseph Lamagna, 716 Central Avenue, Pawtucket, RI
Attorney Lamagna represents claimant Hermano Gaipo, in the amount of $174,894.34.
The claim is based on a final judgment from Superior Court on the cost of inventory and assets of the building owed to Mr. Gaipo. Attorney Lamagna states that Mr. Viveirros owes Mr. Gaipo.
They have no objections to the transfer once the claim is paid.
There are no other speakers.

Communication from Major Arthur J. Martins, Pawtucket Police, to Richard J. Goldstein, City Clerk. (Liquor Sales Violations – Chazarie Inc., d/b/a Broadway Pub, 605 Broadway and Eagle Express Chinese Restaurant Corporation d/b/a Le-Noir Bar, 852 Newport Avenue) is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
With majority consent of the Council, the following motion made by Councilor Wildenhain, seconded by Councilor Hodge, is PASSED on a unanimous voice vote:
The Clerk is instructed to issue summonses to Chazarie Inc., d/b/a Broadway Pub, 605 Broadway and Eagle Express Chinese Restaurant Corporation d/b/a Le-Noir Bar, 852 Newport Avenue, Pawtucket, RI to appear at FORMAL HEARINGS on Wednesday, June 6, 2007, for the following reasons:
1. Sale or delivery of an alcoholic beverage to an underaged person on the license premises for purposes of sale, possession or consumption, on or about March 23, 2007 (R.I.G.L 3-8-1).
2. Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state to be violated in the neighborhood, on or about March 23, 2007 (R.I.G.L. 3-5-23).

Communication from Kenneth Kando, Attorney, to John J. Barry, III. (Rock’s Bar Incorporated, 451 Prospect Street, Outdoor Event – 100th year anniversary) is READ AND ORDERED FILED AND THE REQUEST TO HAVE AN OUTDOOR EVENT ON JUNE 16, 2007, FROM 1:00 P.M. TO 6:00 P.M., IS APPROVED ON A UNANIMOUS VOICE VOTE.

With majority consent of the Council, the following motion made by Councilor Moran, seconded by Councilor Hodge, is PASSED on a unanimous voice vote:
The Clerk is instructed to send a communication to Great Entrepreneurial Endeavors Inc., requesting that a representative attend the Board of Licenses Commissioners meeting on April 25, 2007, at 6:45 p.m., to clarify the change of stockholders at their establishment.
