June 21, 2006

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, June 21, 2006, at 6:55 p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairman Grebien, Councilors Barry, Bray, Clemente, Hodge, Moran, Vitali and Wildenhain.

 

Absent – Councilor Carr.

 

Chairman Grebien presides.

 

The reading of the records of June 7, 2006, is dispensed with and the records are approved as prepared by the Clerk.

 

A public hearing is held on the following application for license, which was advertised for a hearing at this time, is taken up:

 

CLASS B (Victualer) NEW

 

Swades LLC d/b/a Rasoi, 727 East Avenue, LIC#10365

 

Speaking in favor is the applicant, Vandana Dhar, President, 69 Cambria Court, Pawtucket, RI.

 

Mr. Dhar states that he has been in the restaurant business for 19 years.  He has a restaurant on Thayer Street in Providence called Kabob & Curry. 

 

Mr. Dhar states that he is applying for this license because he lives in Pawtucket and wants to operate a business in Pawtucket.  He will also maintain the Providence business.

 

Mr. Dhar states that the restaurant will seat 80 people and will serve Indian food.  The hours of operation will be 11:00 a.m. – 10:00 p.m. Weekdays and will be open until Midnight on Fridays and Saturdays.

 

Councilor Bray cautions Mr. Dhar about keeping the back of the building free from trash and there will be deliveries until 2:00 p.m. only.

 

Mr. Dhar states that he has no problems with Councilor Bray’s concerns.

 

Mr. Dhar distributes a copy of the menu, a parking plan, and preliminary drawings.

 

There are no other speakers.

Upon motion made by Councilor Bray, seconded by Councilor Hodge, the following license is APPROVED on a unanimous voice vote:

Major Arthur Martins, Pawtucket Police Department.

Upon motion mad by Councilor Barry, seconded by Councilor Wildenhain, the following license is SUSPENDED FOR A PERIOD OF FIVE (5) DAYS, SPECIFICALLY FRIDAY, JUNE 23, 2006; SATURDAY, JUNE 24, 2006; SUNDAY JUNE 25, 2006; MONDAY, JUNE 26, 2006, TUESDAY, JUNE 27, 2006, and a $500.00 FINE IS IMPOSED FOR THE FOLLOWING REASON:

 

1.   SALE OR DELIVERY OF AN ALCOHOLIC BEVERAGE TO AN UNDERAGED PERSON ON THE LICENSE PREMISES FOR PURPOSES OF SALE, POSSESSION OR CONSUMPTION, ON OR ABOUT MAY 26, 2006 (R.I.G.L 3-8-1) AND/OR ALLOWING THE POSSESSION OF AN ALCOHOLIC BEVERAGE BY UNDERAGE PERSONS (R.I.G.L 3-8-10), ON OR ABOUT MAY 26, 2006.

Upon motion made by Councilor Moran, seconded by Councilor Hodge, the FORMAL HEARING IS LAID ON THE TABLE AND RESCHEDULED for Wednesday, July 5, 2006, at 6:45 p.m. at the request of applicant’s Attorney, on a unanimous voice vote.

Entire area is temporarily fenced in.

Hire a Pawtucket Police Officer for crowd control.

Use one entrance only.

No one may leave the area with alcohol.

Maximum of 100 people in patio area.

 

Upon motion made by Councilor Vitali, seconded by Councilor Moran, the following Communication is READ AND ORDERED FILED and the request is APPROVED on a unanimous voice vote:
