A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 25, 2006, at 6:50 p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairman Grebien; Councilors Bray, Carr, Clemente, Moran and Vitali.
Absent – Councilors Barry, Hodge and Wildenhain.
Chairman Grebien presides.
The reading of the records of January 11, 2006, is dispensed with and the records are approved as prepared by the Clerk.
COUNCILORS BARRY AND HODGE ARRIVE AT 6:51 P.M.
Communication from Lt. William J. Sisson, Asst. Deputy State Fire Marshal, Pawtucket Fire Department, to Janice M. LaPorte, CMC, City Clerk. (Violations for Macondo’s located at 242 Middle Street) is READ AND ORDERED FILED.
Communication from Frank J. Milos, Jr., Esq., Assistant City Solicitor, to Councilor Paul Wildenhain. (BHAV Liquors Inc., d/b/a JR’s Liquors v. Pawtucket Board of License Commissioners) is READ AND ORDERED FILED.

THE BOARD OF LICENSE COMMISSIONERS RECONVENES AT 7:25 P.M.
A public hearing is held on the following application for license, which was advertised for a hearing at this time, is taken up:
CLASS A
PREVIOUS STIPULATIONS
No delivery on Prospect Street.
Owner to post “No Parking on sidewalk on Prospect Street” inside the store.
Owner shall direct customers to use parking lot on Chestnut Street.
Speaking in favor is Paul Bettencourt, Attorney, 349 Warren Avenue, East Providence, representing the applicant.
Mr. Bettencourt states that Mr. Lomba is retiring from Coast Guard and is en route home and is not able to be present at this meeting.
Mr. Lomba will run the same type of business and will operate the same hours as the previous owner. He states that Mr. Lomba’s wife will be working in the business also.
Councilor Barry states that there has been parking problems on Prospect Street and there is a safety issue.
He asks that stipulations are strictly enforced, and will ask the police department to patrol and enforce the no parking restrictions on Prospect Street.
Mr. Bettencourt states that he will make sure that the owner is aware of the parking restrictions.
There are no other speakers.

Upon motion made by Councilor Barry, seconded by Councilor Vitali, the following licenses is APPROVED with the following stipulations on a unanimous voice vote:

Upon motion made by Councilor Clemente, seconded by Councilor Moran, the License holder HAS ACCEPTED A PLEA OF NOLO CONTENDRE, AND SHALL PAY $500.00 FINE, AND LICENSE SHALL BE SUSPENDED FOR A PERIOD OF (3) DAYS, SPECIFICALLY FRIDAY, FEBRUARY 3, 2006; SATURDAY, FEBRUARY 4, 2006; AND SUNDAY FEBRUARY 5, 2006, FOR THE FOLLOWING REASON:
Possession of an alcoholic beverage by underage persons on the licensed premises (R.I.G.L 3-8-10)
Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state to be violated in the neighborhood, on or about December 4, 2005 (R.I.G.L. 3-5-23).

With majority consent of the Council, Councilor Moran introduces the following Communication:
