August 9, 2006

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, August 9, 2006, at 6:55 p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

 

Present – Chairman Grebien; Councilors Barry, Carr, Clemente, Hodge, Moran and Vitali.

 

Absent – Councilors Bray and Wildenhain.

 

Chairman Grebien presides.

 

The reading of the records of July 19, 2006, is dispensed with and the records are approved as prepared by the Clerk.

 

A public hearing is held on the following application for license, which was advertised for a hearing at this time, is taken up:

 

CLASS B (Victualer) - New

 

Pho Horn’s Inc., d/b/a Pho Horn’s, 50 Ann Mary St. LIC#10366

 

Speaking in favor is the applicant Luan M. Le, Vice President, 26 Richardson Street, Brighton, MA

 

Councilor Barry asks what hours will be.

 

Mr. Le states that it will be open from 11:00 am to 2:00 am.

 

Councilor Barry states that he cannot serve alcohol after 1:00 am.

 

Mr. Le states that he will do what ever the City Council allows. He feels that the City needs good restaurant open late in evening.

 

Councilor Barry suggest a restriction for liquor to be served until 12:00 Midnight.

 

Mr. Le has no objection.

 

There are no other speakers.

THE CHAIR RECOGNIZES COUNCILOR BARRY.

 

Upon motion made by Councilor Barry, seconded by Councilor Hodge, the following license is APPROVED with the following RESTRICTION and STIPULATION on a unanimous voice vote:

 

*RESTRICTION

Alcohol cannot be served after 12 Midnight.

 

STIPULATION

All Employees must be certified in an Alcohol Awareness Training Program.

The matter of a FORMAL HEARING regarding the following license is taken up:

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., Assistant City Solicitor.

 

Representing Bhav Liquors Inc., is Robert Brady, Esq.

 

Also present at hearing is Stenographer Barbara Montijo.

 

THE DETAIL TESTIMONY IS FILED IN THE VAULT OF THE CITY CLERK’S OFFICE.

 

THE CHAIR RECOGNIZES COUNCILOR MORAN.

 

Upon motion made by Councilor Moran, seconded by Councilor Hodge, the License holder HAS ACCEPTED A PLEA OF NOLO CONTENDRE, AND SHALL PAY A $500.00 FINE, AND LICENSE SHALL BE SUSPENDED FOR A PERIOD OF TWO (2) DAYS, SPECIFICALLY MONDAY, AUGUST 14, 2006, AND TUESDAY, AUGUST 15, 2006, FOR THE FOLLOWING REASON:

 

SELLING INTOXICATING BEVERAGES TO AN UNDERAGE PERSON ON THE LICENSE PREMISES (RIGL 3-8-1), ON OR ABOUT JUNE 2, 2006.

 

The FORMAL HEARING on the following license is taken up:

 

CLASS A

 

Tropical Liquors Corporation d/b/a Tropical liquors, 280 East Avenue LIC#10335

 

THE CHAIR RECOGNIZES COUNCILOR BARRY.

 

With majority consent of the Council, the following motion made by Councilor Barry, seconded by Councilor Hodge, is passed on a unanimous voice vote:

 

The Formal Hearing is CONTINUED UNTIL FURTHER NOTICE.  The Transferee is given until 4:00 p.m. on Friday, August 11, 2006, to submit all the necessary documents needed to issue said transfer to Alves Productions Inc., d/b/a Tropical Liquors, 280 East Avenue, Pawtucket, RI.  Failure to do so will result in a Formal Hearing.

 

Communication from Loubnen Sukkar, President of the Cedar Foods LLC d/b/a Lang’s Villa, 47 Mendon Avenue, to Pawtucket Board of License Commissioners, requesting permission to sell beer and wine, non-alcoholic beverages, grilled food and to have entertainment in the parking lot, 47 Mendon Avenue, on Friday, September 1, 2006, from 6:00 p.m. to 10:00 p.m. is READ AND ORDERED FILED AND THE REQUEST IS APPROVED ON A UNANIMOUS VOICE VOTE.

Petition of Church of the Assumption, 97 Walcott Street, to sell alcoholic beverages at an Annual Church Festival on the Church Grounds, on Friday, August 18, 2006, from 5:00 p.m. until 11:00 p.m.; Saturday, August 19, 2006; Sunday, August 20, 2006, from 12:00 p.m. until 12:00 a.m., LIC#173

 

THE CHAIR RECOGNIZES COUNCILOR CLEMENTE.

 

With majority consent of the Council, Councilor Clemente introduces the following communication:

 

Communication from Major Arthur J. Martins, Police Department, to the Board of License Commissioner.  (State of RI Alcohol Sale Compliance Checks – Fairlawn Wine Company Inc.)

 

Upon motion made by Councilor Clemente, seconded by Councilor Vitali, the following communication is READ AND ORDERED FIELD:

THE CHAIR RECOGNIZES COUNCILOR CLEMENTE.

 

With majority consent of the Council, the following motion made by Councilor Clemente, seconded by Councilor Vitali, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to issue a Summons to Fairlawn Wine Company, Inc., 551 Smithfield Avenue, Pawtucket, RI, to appear at a FORMAL HEARING on Wednesday, September 20, 2006, for the following reason:

 

1.   Selling intoxicating beverages to an underage person on the license premises (R.I.G.L 3-8-1), on or about July 21, 2006.

 

Upon motion made by Councilor Hodge, seconded by Councilor Vitali, the meeting is adjourned at 7:14 p.m.
