Pawtucket Board of License Commissioners

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, September 21, 2005, at 7:13 p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairman Grebien, Councilors Carr, Clemente, Hodge, Moran, Vitali and Wildenhain.
Absent – Councilors Barry and Bray.
Chairman Grebien presides.
The reading of the records of September 7, 2005, is dispensed with and the records are approved as prepared by the Clerk.
THE CHAIR RECOGNIZES COUNCILOR HODGE.
With majority consent of the Council, Councilor Hodge introduces the following communication:
Upon motion made by Councilor Hodge, seconded by Councilor Vitali, the following communication is READ AND ORDERED FILED.
A public hearing is held on the following application for license, which was advertised for a hearing at this time, is taken up:
CLASS A
Shree Balaji Corporation, (transfer from Murphy’s Liquors Inc.) 290 Pawtucket Avenue, LIC#10353
Representing the applicant is Barry J. Kusinitz, Attorney, 155 South Main Street, Providence, RI.
Also present is applicant Ajay Dabhi, 3 Baldwin Circle, Shrewsbury, MA
Mr. Kusinitz states that the applicant has held other liquor licenses in other states (New Hampshire, Massachusetts) and he is familiar with the law in running this type of establishment.
Councilor Hodge questions the applicant’s affiliation with a liquor store in Massachusetts, as indicated on the application.
Mr. Kusinitz states that a separate corporation owns one store in Massachusetts
Mr. Milos, in answer to President Grebien’s question regarding the law restricting chain store franchise in Rhode Island, states he is uncertain if the Massachusetts store is a different entity.
Mr. Kusinitz states that the Massachusetts store is a different entity from the Rhode Island Corporation.
There are no other speakers.

THE CHAIR RECOGNIZES COUNCILOR HODGE.
Upon motion made by Councilor Hodge, seconded by Councilor Moran the following license is GRANTED subject to the applicant producing a copy of it’s Massachusetts Corporation Structure to show that it is a separate corporation and to insure compliance with Rhode Island laws regarding the prohibition of Chain Stores, and pending the settlement of all outstanding claims, on a unanimous voice vote:

THE CHAIR RECOGNIZES COUNCILOR CLEMENTE.
With majority consent of the Council, the following motion made by Councilor Clemente, seconded by Councilor Hodge, is PASSED on a unanimous voice vote:
The Clerk is instructed to send a communication to Major Stephen P. Ormerod, requesting for a status report on the Council’s request for Class BV liquor license compliance checks.
A report is requested in time of the next meeting scheduled for Wednesday, October 5, 2005.
Upon motion made by Councilor Moran, seconded by Councilor Hodge, the meeting is adjourned at 7:30 p.m.
