March 9, 2005

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, March 9, 2005, at 6:55 p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairman Grebien, Councilors Barry, Bray, Carr, Clemente, Hodge, Moran, Vitali and Wildenhain.

 

Absent – 0.

 

Chairman Grebien presides.

 

The reading of the records of February 9, 2005, is dispensed with and the records are approved as prepared by the Clerk.

 

A public hearing is held on the following application for license, which was advertised for a hearing at this time, is taken up:

 

CLASS B (Victualer) – Requesting change from Class B Limited.

 

Nicholas T. Georgitsis d/b/a Cup N Saucer, 267 Main Street, LIC#10341

 

Speaking in favor is Nicholas T. Georgitsis, 18 Sherri Dr.,  North Providence, RI.

 

Mr. Georgitsis responds to questioning from Councilor Clemente, and states that this request is to allow for the sales of alcoholic beverages and not just beer and wine.

 

The next speaker is Wayne Wunschel.

 

Mr. Wunschel states that he is speaking on behalf of Mr. Georgitsis.  He works for an insurance firm across the street from the Cup N Saucer and has come to know Mr. Georgitsis and his wife and says that they run an excellent business and he is in favor of their request.

 

There are no other speakers.

 

The hearing is closed.

 

THE CHAIR RECORGNIZES COUNCILOR CLEMENTE.

 

Upon motion made by Councilor Clemente, seconded by Councilor Barry, the following license is APPROVED on a unanimous voice vote:

 

CLASS B (Victualer) – Requesting change from Class B Limited.

The matter of a FORMAL HEARING regarding the following license is taken up:

 

CLASS A

 

Great Entrepreneurial Endeavors Inc., d/b/a Gee’s Liquor, 400 Broadway, LIC#10284

 

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., Assistant City Solicitor.

 

Also present at hearing is Stenographer Sandra Bachini Gaboriault.

 

THE DETAIL TESTIMONY IS FILED IN THE VAULT OF THE CITY CLERK’S OFFICE.

 

THE CHAIR RECOGNIZES COUNCILOR MORAN.

 

Upon motion made by Councilor Moran, seconded by Councilor Barry, the License holder HAS ACCEPTED A PLEA OF NOLO CONTENDRE, AND SHALL PAY $500.00 FINE, AND LICENSE SHALL BE SUSPENDED FOR A PERIOD OF TWO (2) DAYS, SPECIFICALLY SUNDAY, MARCH 13, 2005, AND MONDAY, MARCH 14, 2005, FOR THE FOLLOWING REASEON:

 

SELLING INTOXICATING BEVERAGES TO AN UNDERAGE PERSON ON THE LICENSE PREMISES (RIGL 3-8-1), ON OR ABOUT DECEMBER 31, 2004.

 

FAILURE TO MAINTAIN CONTROL OF PATRONS AND/OR EMPOLYEES, AGENTS, ENDANGERING THE HEALTH, SAFETY AND WELFARE OF THE GENERAL PUBLIC.

 

Communication from Thomas Brennan, Celtic Pub, 755 Broadway, to the Honorable City Council, requesting to permission to serve alcoholic beverages from a tent in the parking lot on Thursday, March 17, 2005, from 4:00 p.m. until 12:30 a.m. is READ AND ORDERED FILED.

 

Upon motion made by Councilor Moran, seconded by Councilor Vieira, the meeting is adjourned at 7:05 p.m.
