Pawtucket Board of License Commissioners
June 22, 2005
A regular session of the Pawtucket Board of License Commissioners is held Wednesday, June 22, 2005, at 7:08 p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairman Grebien, Councilors Barry, Bray, Clemente, Hodge, Moran, Vitali and Wildenhain.
Absent – Councilor Carr.
Chairman Grebien presides.
The reading of the records of June 8, 2005, is dispensed with and the records are approved as prepared by the Clerk.
A public hearing is held on the following application for license, which was advertised for a hearing at this time, is taken up:
CLASS B (Victualer)
Representing the applicant is Attorney Mark Welch, 141 Power Road, Pawtucket, RI.
Also present is applicant and sole officer, Armand Desnoyers, 29 Randolph Ave., So. Attleboro, MA.
Mr. Welch states that Mr. Desnoyers will operate Garrity Pub & Restaurant as a small pub and restaurant. He will not be have large banquets at this location at this time. It will be a much smaller scale restaurant than what was there previously. Mr. Desnoyers will abide by all previous stipulations.
The hours of operation will be 4:00 PM-1:00 AM. He will not require an entertainment license. The parking lot can accommodate 80 vehicles.
Upon questioning by Councilor Moran, Mr. Desnoyers responds that he will not be the manager on duty – that person will be hired as soon as the license is issued. There are some state health department issues as well as some fire code issues which need to be corrected before the license can be issued.
Also in response to Councilor Moran, Mr. Desnoyers states that the building will be sectioned off to accommodate only 50-60 patrons, there are no plans at this time for the rest of the building.
Councilor Wildenhain states his disappointment that this will no longer be used as a banquet facility.
Councilor Moran states that he would not have a problem if Mr. Desnoyers decided to go back to a banquet facility at a later date.
The next speaker is Tom Gordon, 54 Garrity Street.
Mr. Gordon states that he has no problem with a small pub and restaurant idea; however, he does have a problem with a banquet facility. He states cars are parked all over the neighborhood and this causes heavy traffic and problems for the residents to park at their homes.
The next speaker is Michael D. Cassidy, Director, Planning and Redevelopment. Mr. Cassidy states that the previous owner had zoning violations due to illegally storing a trailer on this site. Mr. Cassidy is requesting the Council to make sure the trailer is removed and all the items inside the trailer are to be stored inside the building.
Mr. Welch states that all zoning violations will be corrected within 30 days.
The next speaker is Ronald Perry, 47 Garrity Street, Pawtucket, RI
Mr. Perry states that he has no problem with the pub style type of restaurant; however, he is in opposition to a banquet facility. Mr. Perry also states that he would like to see an 11:00 p.m. closing time, not 1:00 a.m.
There are no other speakers.

Upon motion made by Councilor Moran, seconded by Councilor Vitali, the following license is APPROVED ON A UNANIMOUS VOICE VOTE, WITH THE FOLLOWING STIPULATIONS, subject to the payment of all outstanding claims and violations:

*STIPULATIONS
All bartenders shall be TIPS Certified
One member of management shall be on duty at all times
Licensee shall notify District Councilor of any changes at establishment
Licensee shall notify District Councilor when the establishment will be officially opened
Licensee shall provide a list of all employees within 30 days of issuance of license.
Pawtucket residents shall be given preference for employment
A detail officer shall be hired for any function with more than 250 people
Licensee shall have 6 months from date of granting to open – if extension is need, licensee shall notify the opening status to the Board of License Commissioners
Licensee shall remove remaining storage trailer and its contents within 30 days of the granting of this license transfer.
The matter of a INFORMAL HEARING regarding the following license is taken up:
CLASS A
Manmar, Inc., d/b/a East Street Liquors, 183 East St. LIC#10289
Major Stephen Ormerod reviews the complaints of disorderly behavior from the rear of East Street Liquors, 183 East Street, which indicate that there are youths congregating in the rear parking lot of the liquor store.
Some of the complaints include loud noise, rowdy behavior, running through neighborhood yards and drinking at the establishment and at the John Street Playground. The alcohol was purchased at East Street Liquors. Major Ormerod states that the owner is reluctant to admit the problems come from the liquor store.
Manuel Barreira, owner of the store is present and is represented by his son.
Mr. Barreira states that his father has owned the store for five years and has never had any problems. He does not allow drinking in the store, and states that he cannot control what goes on outside his store.
Councilor Moran states that Mr. Barreira must not allow loitering in the lot and states that this informal hearing is a warning that if this continues he will call a formal hearing and possibly impose a fine and/or suspension. Mr. Barreira must adhere to the laws and must call the police if there are any problems.
The informal hearing is closed.
Communication from Ted P. Jackvony, President, Jacks Are Wild, Inc., d/b/a Left Field Bar & Grill, to the Honorable Members of the Pawtucket City Council requesting permission to serve food and alcoholic beverages in the parking lot of 156-158 South Bend Street on Sunday, July 3, 2005, beginning at 4:00 p.m., and is APPROVED WITH THE FOLLOWING STIPULATIONS TO REMAIN IN PLACE, on a unanimous voice vote.
STIPULATIONS:
Entire area is temporarily fenced in.
Hire a Pawtucket Police Officer for crowd control.
Use one entrance only.
No one may leave the area with alcohol.
Maximum of 100 people in patio area.
Communication from Mei King Restaurant, 211 South Bend Street requesting permission to sell food and soda from the parking lot of 211 South Bend on Sunday July 3, 2005, from 7:00 p.m. – 10:00 p.m., is READ AND ORDERED FILED, and is APPROVED on a unanimous voice vote.
Communication from Ralph T. Garner, President of Country Lounge Inc., d/b/a Tommy’s Lounge, 99 India Street, to Pawtucket City Council, requesting the police detail officer on Fridays and Saturdays be reviewed, is READ AND ORDERED FILED and the request to remove the stipulation on this license for a police detail on Friday and Saturday nights is DENIED on a unanimous voice vote, and the detail officer shall remain in place for the next 90 days, at which time this stipulation may be reviewed.

The number of disturbances at this establishment, specifically, the stabbing on April 5, 2005, and the assault with a machete on June 4, 2005.
Failure to maintain control of patrons and/or employees, agents, endangering the health, safety and welfare of the general public.
