Pawtucket Board of License Commissioners

April 20, 2005

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 20, 2005, at 6:55 p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.  

 

Present – Chairman Grebien, Councilors Bray, Carr, Clemente, Hodge and Moran..

 

Absent – Councilors Barry, Vitali and Wildenhain.

 

Chairman Grebien presides.

 

The reading of the records of April 6, 2005, is dispensed with and the records are approved as prepared by the Clerk.

 

A public hearing is held on the following application for license, which was advertised for a hearing at this time, is taken up:

 

CLASS B (Victualer)

 

Lionheart Marketing Corp., d/b/a Garden Grill, 727 East Avenue, LIC#10344

 

Speaking in favor is Michael Horan, Attorney, 393 Armistice Boulevard, representing the applicant.

 

Mr. Horan states that the Garden Grill is in the Plaza on East Avenue, Mr. Yaffe has been in the business for 9 years and he is asking for liquor license.

 

Councilor Bray asks if Mr. Yaffe is the sole owner of the business. 

 

Mr. Yaffe states that he is the sole owner and has been for 9 years.

 

He states that he will serve beer and wine only.  There will be no entertainment.

 

Mr. Yaffe states that all employees are TIPS certified.  The capacity is 45-50 people.  There will be no bar.  He is asking for a liquor license to compliment the meals only.

 

Councilor Bray is concerned about the storage in the back of the building.

 

 Mr. Yaffe states that it is taken care of.  There will be no outside storage in the back.

 

The hours will be Monday through Friday 11:00 am to 9:00 pm., Saturday 10:00 am to 10:00 pm. He states that the hours will not change.

 

Speaking in opposition is Paulette Green, 22 Lowden Street.  Ms Green states that she lives in the back of the store.

 

Ms. Green is concerned about outside storage.

 

Councilor Bray states that this will be one of the stipulations on the license.

 

Speaking in opposition is Carl Salvo, 17-19 Pidge Avenue.

 

He is concerned about the changes in the Oakhill neighborhood.

 

Mr. Salvo reads from a prepared statement which he submits for the record, and is READ AND ORDERD FILED.

 

Speaking in opposition is George Carvalhal, 284 Lafayette Street.

 

Mr. Carvalhal states that he has no problem with the Garden Grill, the only concern he has is what is going to happen with the license when it gets sold or transferred.

 

Councilor Bray states that any transfer would have to be approved by the Board of License Commissions.

 

Speaking in opposition is Linda Holt, 67 Germania Street.

 

Mrs. Holt states that she has no problem with the Garden Grill.

 

She is concerned with the cleaning crew at night. She states that Mr. Yaffe needs to be more responsible.  She states that the back door is open and there is clanging of dishes, foul language, and loud music.

 

She states that nobody shovels the back walk.  

 

Councilor Bray states that she will have a neighborhood meeting.

 

Mr. Salvo speaks again that there is a problem with this shopping center.  He states that zoning determined that all loading and unloading should be in front of the building only. 

 

There are no other speakers.

 

The Hearing is closed.

 

THE CHAIR RECOGNIZES COUNCILOR BRAY.

 

Upon motion made by Councilor Bray, seconded by Councilor Hodge, the following license is APPROVED with the following stipulations, on a unanimous voice vote:

No Entertainment.

No outside storage.

Close by 10:00 p.m.

The matter of a FORMAL HEARING regarding the following license is taken up:

 

CLASS D

 

Howard-Rogers Holding Corporation Inc., 25 McCallum Avenue, LIC#10109

 

Representing the City of Pawtucket is Frank J. Milos, Jr., Esq., Assistant City Solicitor.

 

Present is Antony S. Gomes, President of Howard-Rogers Holding Corporation Inc.

 

Also present is Officer Ernest Pendergrass, Capitan Patrol Division, Glenn Haberle and Major Steven Ormerod.

 

Also present at hearing is Stenographer Sandra Bachini Gaboriault.

 

THE DETAIL TESTIMONY IS FILED IN THE VAULT OF THE CITY CLERK’S OFFICE.

 

THE CHAIR RECOGNIZES COUNCILOR MORAN.

 

Upon motion made by Councilor Moran, seconded by Councilor Hodge, a FORMAL WARNING IS IMPOSED AND LICENSE HOLDER SHALL PAY A $250.00 FINE, FOR THE FOLLOWING REASON:

 

OPERATING AFTER HOURS (RULE #24 – LIQUOR CONTROL ADMINISTRATION)

 

FAILURE TO MAINTAIN CONTROL OF PATRONS AND/OR EMPLOYEES, AGENTS, ENDANGERING THE HEALTH, SAFETY AND WELFARE OF THE GENERAL PUBLIC.

 

Upon motion made by Councilor Moran, seconded by Councilor Hodge, the meeting is adjourned at 7:55 p.m.
